To me - A Native English speaker of Australian English - you are correct anh Stefan. This is very, very complicated but legally important English wording. A single wrong translation of the MEANING AND/OR INTENT of the original author could be a disaster in a British Court. As a professional translator with some experience contract and legal translation, I would not use the previously suggested Vietnamese translation: the 2 texts mean different things in a court of law in the U.K.. End of story!

 

   I am busy today and tomorrow, but I will translate the LEGAL MEANING under situations where the rule of law is adjunct to the power of governments to propose those laws.

Dear CACC,

Good issue you raise, anh Stefan. I hate legalese. I really think
that legalese is the language created by lawyers to bar normal people
from the legal market and to monopolize that market.

Anyway, now that we are stuck with it. Here is the order of reading
and translating:

1. The client tells his lawyer what he wants in civilized English.
2. His lawyer translates his words into English legalese for other
lawyers to understand.
3. Vietnamese lawyers translate this English legalese into Vietnamese legalese.
4. A lawyer (or non-lawyer who is well versed in legalese)
translates Vietnamese legalese to civilized Vietnamese for everyone
else.

If we skip steps 2 and 3 above, we would go directly from 1 to 4. The
world would function much better and faster.

We don't see step 1 here, but chi Hoang Anh's translation is a superb
step 4. Great translation! I'm impressed.

Unfortunately, it seems since we have step 2 here it must be
translated into step 3 for the lawyers out there. :-(
