A WRAP UP.....Report #5 on the Declaration revision attempt

Hello all......this has been delayed due to some family and other V.V.
issues

Starting at the voting from early March to first deadline April 15,
2011, not enough consents to petition court so extended the deadline
to May 9th (foul?) but kept on counting votes after that (foul!). A
screwed-up count with late votes and other mis-tallied ones ended up
in the association's legal petition to the court. All in...."The
Tally Ho, ho, ho....." Report #1.

"A Reprieve", report #2, alerted owners to the situation in 2 areas re
Special Assessments.....if they couldn't get an assessment one way,
there was another. Going to need hitting the owners' pocketbooks one
day soon if the past yearly negative net incomes continue status quo.

Report #3 (in 2 parts)....."What Really Happened at the 11/14/11
executive session" (illegal to start with)........a revealing glimpse
of information manipulation as the wizards from our very own OZland
pushed buttons, pulled levers, sent up smoke until the curtain was
briefly parted.

Report #4......."Meetings & Minutes......more or less a mess" - this
one got the goats of some directors. I put down their own words from
minutes and events from my own meeting notes, and yes, came to some
unflattering conclusions. Basically, the petition drive was hustled
along sans the membership being afforded opportunity to step up and
speak out directly to board before it was filed in court.

The failed attempt and folly involved culminated in my March 12, 2012
letter to board explaining my perspective of the problems and calling
for the resignations of the president and the vice-president as
accountability for financial waste (put it on the forum verbatim).

They'll be back in due time, all sunshine and smiles, with another
proposed revision, perhaps a lot better than the last one BUT that's
up to owners who participate as well. Opportunities should be
presented to give your input on needed changes. Ignore these
opportunities to your peril, especially permanent owners, whether
resident or absentee.

If only a handful of members print out these reports and keep them on
file, it will have been worth my time and effort. When next attempt
is made, they may help you understand what happened "the last time".

Copies of these with a cover letter will be sent to Aaron Acker, the
HOA Information Officer in Denver. While common sense cannot be
legislated and transparency of action only marginally so, this is the
kind of information his office needs to determine what are some
problems owners face with their HOA boards. In this case, it'll be a
stark example of how NOT to conduct a Declaration revision/petition
effort.
