To those who read it, that is.............
On Finances: The figure of $42,010 stated for the net loss of income
is from the EOM December 2011 balance sheet. But that is NOT the
entire picture! The association did not pay all or some of December's
bills until January 2012, payments in arrears.
The actual Expenses Over Income loss is <$86,938>!! If there's
another explanation for the disparity of figures, perhaps the
treasurer would share that with us.
Has the board reviewed the 2011 Audit? Owners can get one via e-mail
by request to Z&R or call for a hard copy.
The Front-Page Mislead - The judge did NOT say the objections to the
content of the revision... .'had no merit'. He referred to one
argument based upon the Colo. Revised Non-Profit Corporation Act
relating to THE PROCEDURE as.....'unconvincing'......finding no merit
to the 60-day window of voting requirement.
Let's get it verbatim from the order: "The Court finds that it does
not presently have jurisdiction to hear the individual challenges to
the various amendments. The Court has a finite responsibility under
the law which limits review to THE PROCESS under the petition
amendment procedure......and NOT the substance of the particular
amendments" (emphasis mine).
He did not rule on but expressed his opinion that there was no merit
to the argument that capping rentals in the community is
unconstitutional.......period.
Further....."the Court shares the Respondents' strong concern about
specific compliance with Colorado law as to some of the specific
amendments and............. "Therefore the Court must decline to delve
into these challenges for purposes of this hearing until such time as
the Petitioner attempts to actually implement or enforce some of the
LEGALLY QUESTIONABLE PROVISIONS" (emphasis mine).
She did get the first sentence right........a denial for...'lack of a
meeting with the members and 2 notices'. But how did such LACK occur
when they'd been working since March 2011 on the 2nd revision
attempt?? More upcoming on their Declaration Debacle.
