Dear Brig Dhand,

 

1.  As on date there is no Govt Letter  on the subject . 

2. On implementation of AVS Committee's recomendations Part-1  w e f 16 Dec 2004, Lt Cols with 26 years or more reckonable service for promotion became eligible for getting pension of Col(TS) . However, only those who were in service as on 16 Dec 2004  only were considered for the same. Those who retired prior to 16 Dec 2004 were not given the benefit. I  retired on 30 Apr 1997, as a Selection Grade Lt Col, having put in 28.5 years of pensionable service. I therefore represented to MOD  that I & pre-16 Dec 2004 retiree Lt Cols who had putin 26 years or more reckonable service  should also be considered to be eligible for  pension of  Col(TS). My request was turned down and hence I filed a case in AFT(Principal Bench), New Delhi,through TSEWA headed by Brig Vidyasagar  on 16 Jun 2016. THe AFT Case No is OA664/2016. There were 325 litigants and I was the Lead Litigant. Subsequently , 24 litigants did not submit requisite documents / were found to be not meeeting the criteria . THe criteria were:- (1) Pre-16 Dec 2004 retiree LT Col,(2) Should have put in  26 years or more reckonable service for promotion.Thus the total No of Litigants became 301 including me.MOD  kept dragging the case by not submitting Counter Affidavit(CA).THen the COVID period came and no progress was made till then. Soon after reopening of the case after Covid stalemate, MOD Lawyer objected to the fact that so many litigants(301 litigants)  , that too from Army, Navy & Air Force can not jointly file a case . The Court  gave in to the MOD's argument  and deleted name of all 300 co-litigants and retained only the name of Lead Litigant , that is me. Now the case is being fought by me alone. Our Lawyer is Brig A K Srivastava who retd from JAG Branch and is located in Gurgaon.  Next hearing of the case is on 14/11/2022. THe case at present is in argument stage. Hopefully, after 3 to 4 hearing the Cour may give the verdict. 

3.  In the meanwhile, a retd CDR   from Navy, who is also a Lawyer, had filed an identical case in AFT Chennai. The Judge, none other than the Charman of AFT, Srei Rajendra Menon , gave a positive verdict in his case. He was granted pension of Col(TS). Not only that , in his judgement, Chairman of AFT  granted the benefit for all similarly placed Lt Col or equivalent rank pensioners. The verdict was given last year. It was to be implementd within 6 months. But MOD did not implement it. Not only that they have not filed any review petition on the verdict, so far. Cdr S P Elangoan, who is the litigant, is trying to file a petition on non-implementation of the verdict, in Supreme Court. 

4. In short,   pension of Col(TS)  for  pre-16 Dec 2004 retd Lt  Cols with 26years or more reckonable service for promotion  , has not been granted by the Govt. Whaever, Whatsapp messages are floating aroung in the environment is nothing but fake and one need not take cognisance of the same.
