  Dear All, I had it checked up with Maj Navdeep who is quoted to have contested the case in courts on exemption of toll tax. He  has intimated that the said letter is fake. The exemption is available only to the serving Defence pers  Col Madan Sharma

    By not voting you are helping indirectly the parties against whom you
     
    have grievances. It is very common for the political parties to make
     
    tall promises before elections and forget them thereafter. It is
     
    strange that you are ready to vote for a party, which promises to work
     
    for welfare of ESM , being aware of their past record..I think it will
     
    be better to support a promising independent candidate, with a clear
     
    understanding of what you expect from him in return for your support.
     
    In the coalition era prevalent today, independents and small parties
     
    can have a say in policy matters and cannot be ignored. Here in
     
    Uttarakhand Lt Gen T P S Rawat, after hobnobbing with both, the
     
    Congress and the BJP, has formed Uttarakhand Raksha Morcha, which is
     
    fielding candidates for 60 out of 70 seats. They include many retirees
     
    from defence forces and civil services.Even if they get a few seats,
     
    they will be in a position to put up the views of service class of
     
    people effectively to whichever party forms the govt.

    It is not advisable to boycott elections for ESM in Punjab Assembly
     
    Elections. The ESM Veterans can speak up their grievances to captain Amrinder
     
    Singh and decide on voting the Congress party.
     
    otherwise , it shall be just wastage of their right to Vote. It is not
     
    going to help in any way by not exercising your right to vote.Please take you
     
    decision back and contact captain Amrinder Singh on the said grievances.
     
    And advise the ESM to vote for Congress and remove SAD/BJP Govt. from
     
    the scene. Please do not waste your vote.

    The extraordinary judgemental interest in the media against the Chief's DOB
     
    arouses suspicion.
     
    Your query is understandable consequence of the Media Blitz, obviously
     
    motivated.
     
    Having said that, let me clarify that the Chief would have been eligible
     
    for entry to NDA even with 1951, the correct DOB. That time the age limit
     
    was 14.5- 16 or 15-16.5 or something similar. I am a couple of courses
     
    senior to Gen VK Singh, and had joined NDA with 15 yrs 4 months age. There
     
    were some younger, with just 15 and 3 months.
     
    The entry gained to NDA is not based on just your say so on the form. That
     
    just remains 'provisional' till a PROOF of DOB is submitted, ie the School
     
    Leaving Certificate in this case. That having been done, the AGs branch
     
    seems to have corrected the records, while the MS branch has not.
     
    The Book Keeping is done by AGs branch,which everyone else, including MS
     
    branch needs to synchronize with. Apparently in this case, like some
     
    others, this has not been done.
     
    The matter really is simple. Its a reconciliation, with the MS requiring to
     
    correct records. However, for reasons not known in public domain,but
     
    speculated, the establishment- politico bureaucratic combine, is keen to
     
    push the unauthentic date to correct the verified correct one.
     
    This is not a simple case. Gen VK Singh is a victim, not a villain as is
     
    being made out.

    A candidate for entry to the NDA had to be between 15 and 17.5 years
     
    as on 1 Jan or 1 Jul for the term commencing in that particular month.

    VKS & self joined the NDA together in July`66, The age at entry at that time was 15 to 171/2 & min edn 10th pass. Even if result was awaited for 10th class one could still join provisionally & later produce the 10th pass certificate from the school. So he was very much within age limits if dob is 10 May`51. I recall a cadet of my school had to leave NDA after Ist term because he failed in 10th class. He joined later on passing Senior Cambridge. What is baffling is why he did not fill the NDA exam form himself as most of us did before joining & going through a number of stages before final selection to the NDA. What happened later has been `thrashed` threadbare & beautifully given in Lt Gen Vijay Oberoi`s article in the Tribune on 10 Jan`12. He should `stick to his guns` or else resign imdt & go to Court. Let the Govt `fight` over the next Chief - `Dood Ka Dood aur Pani Ka Pani Patta chal jayega` !!!

    army officer and was born at a military hospital and certificates given by
     
    m h . the a g 's records should have more weightage as against M S
     
    . eariler more than 8 years back the M S has got a clarification from the

    the government is trying . to fix him for no fault of his.

    Upholding provisions of the 105-year old Indian Tolls Act, the Supreme
     
    Court on Friday dismissed a special leave petition (SLP) seeking withdrawal
     
    of concessions provided to Armed Forces personnel under the Act.
     
    A Division Bench comprising Mr Justice Ashok Bhan and Mr Justice Markandey
     
    Kadju declined to interfere in the directions issued by the Punjab and
     
    Haryana High Court, which had dismissed a petition filed by a Chandigarh
     
    resident, Sanjeev, in May. Sanjeev had challenged the provisions of the Act
     
    on the ground that it was discriminatory, unconstitutional and against the
     
    spirit of Article 14 of the Constitution of India which provided for
     
    equality before law. He had also contended that other central government
     
    employees and members of the para military forces are not entitled to such
     
    concessions.
     
    The HC Division Bench, comprising Mr Justice H S Bedi and Mr Justice Ranjit
     
    Singh, however, ruled to the contrary and had dismissed the petitioner’s
     
    contentions. Thereafter, he had filed a SLP in the apex court against the
     
    HC order.
     
    Section 3(a) of the Indian Tolls (Army & Air Force) Act, 1901, provides for
     
    toll tax exemption on all public or private roads and bridges in India to
     
    officers and men of the regular forces whether they are on duty or not.
     
    Further civil vehicles and animals moving under military orders, are also
     
    exempted from payment of toll tax. The Act also has an overriding clause,
     
    which causes it to override all other Acts or directions by any legislature
     
    or central or state government in India.
     
    The controversy regarding applicability of the Act began a few years ago,
     
    when private toll operators under the Build-Operate- Transfer (BOT) system
     
    on various roads and bridges had started refusing toll exemption to defence
     
    personnel and in certain cases even to defence vehicles.
     
    The issue had then been settled after Chandigarh-based lawyer, Capt Navdeep
     
    Singh, took up the matter with the Central Government in 2004 and
     
    instructions were issued by government thereafter that the Act was very
     
    much applicable to toll roads and bridges being operated under the BOT
     
    schemes or otherwise. The instructions also clarified that the Act was
     
    applicable even to private vehicles belonging to personnel of the regular
     
    forces.
     
    While the problem of illegal charging of toll tax has more or less been
     
    settled with the instructions being circulated all over, sporadic incidents
     
    of harassment of defence personnel continue to be reported mainly from the
     
    Delhi-Noida- Delhi Flyway and from some areas of Himachal Pradesh.

    Dear Sirs,
     
     
    1. Can any body venture to enlighten and educate what is likely the
    shape of things to come vis-a-vis, 17 Gorkhas Regiments serving in the
    Indian Army, if debarred by the New Nepal Dispensation. Did Meneckshaw
    belonged to Gorkha Regiment!
     
    2. Great Britain has literally dumped them-differential pensions, no
    permanent citizenship, etc, after squeezing them for life. UK is no
    more in the business of ground military engagements. Europe is
    steadily becoming a Union of treacherous trade of the 16/17/18th
    Centuries of trade and gun diplomacy because they cannot afford guns
    and boats and with dwindling children being born to couples where the
    parents are loathed to send their wards to get killed or wounded for
    some body else's wars and their Political Leaders of democracy in
    being in danger. Money, technology and white skin will do for them.
     
    3. Even the Indian Army took 7/8 years to give ECHS cover to Gorkha
    Soldiers since the inception of ECHS for the Veterans in 2004. It is
    usual for the MOD to split hair and allow the things to drift when the
    need is not acute. They are not known to think long term. They closed
    the Air Base in Tajikistan and now are trying to revive, if at all
    they succeed..
     
    4. MOD can still mend its fences. I believe there are 6 million
    Nepalese Indians with dual citizenship and many come as Watchmen to
    eke out their living. Not all are bad. May be our treatment lacks some
    thing.
     
    May be GOI can solve in way it is solving NRIs problems with
    attractive foreign countries and proper protocols with Nepal. USA
    today grants Green Card the aspirants to the aspirants who are
    selected. And citizenship if not killed in war. Plus there are many
    more incentives. Another likely scenario which may come that Europe to
    may give permanent residency or citizenship to Indians to join their
    Armies in the not distant future.
     
    Sadly, MOD treatment of its own serving and Veterans to say the least
    is degrading. GOI must be aware that not many parents are willing to
    send their Child of the 1/2 Family they have were the Bureaucracy and
    the Political Leadership are not even willing to talk to then even at
    their annual service memorial functions. Even our very own IDSA only
    sit in ivory towers and suppress gag at every opportunity and place,
    the Uniform and the Veterans do not even count.
     
    The shortage of officers in the Armed Forces is not due other reasons
    that perhaps are alluded to above.

    I have been getting this privilege on my road travels in the northern
    part of Kerala, but I have seen many veterans express their anguish at
    not getting it. If the legal luminary Maj. Navdeep Singh can be taken
    as a reasonably good authority on the subject, what I am getting here
    is probably due to the ignorance of the toll gate attendees....not a
    privilege in its true sense. So I am not going to complain next time
    when they stop me and ask me to pay up.

Dear All Veterans
