The MOD letter does not specify to whom it applies-- Brig Kamboj's surmises that 

"For grant of Rank Pay arrears the order does not make any distinction among officers who retired before or after 01 Jan 1986 – SO PLEAES RELAX".

"Salary of all officers whether they retired before 01 Jan 1986 or after that date, will be revised upwards." 

"2.    The officers who retired before 01 Jan 1986, will get half of the rank pay as addition to their earlier pension, starting from 01 Jan 1986, till 31 Dec 2006."

may not be appropriate, I feel. Please see my letter to MP 5&6 and their reply reproduced below (which I fwd to you all already);

Sir,
I am sorry that I am intruding on your valuable time and Computer Bytes / Mail Box and adding to your work load - I couldn't help it as can be seen from the rest of this mail.  I have just one question - why have pre-1-1-1986 retirees been excluded in this exercise?  In their case, the re-fixation of their basic pay on a Notional Basis wef 1-1-1986 as per V CPC is required to be carried out by PCDA(O). Thereafter the revision of their Pension Notionally wef
1-1-1986 be done followed by their  pension revision wef 1-1-1996 (as per VCPC guidelines) based on the Notional Pension wef 1-1-1986, is required to be carried out by the PCDA(P), to achieve MODIFIED PARITY of the Pre -1-1-1986 retirees with POST-1-1-1986 /1-1-1996 retirees.
Actually there is a greater urgency to carry out the exercise in the case of the Pre-1-1-1986 retirees in view of their ULTRA SENIOR STATUS Agewise, most of them being 80+ years of age and some of their Family Pensioners also being similarly affected due to the demise of the pensioner by now.
May I request you to kindly give this a serious thought and cater for the needs of the
Pre-1-1-1986 retirees / Family Pensioners too . I hope that the second list you propose to issue next month will include the Pre-1-1-1986 retirees / Family Pensioners.

Sir,
While what you say has merit, it is beyond the purview of the current case. I am only assisting in the preparation for implementation of the Supreme Court ruling once Govt orders are issued.

I asked MP 5&6 regarding the pre 1-1-1986 retiress' Notional Pay fixation wef 1-1-1986 and the subsequent modified parity wef 1-1-1996-- their reply says IT IS BEYOND THE PURVIEW OF THE PRESENT CASE and they are concerned with implementation of the Supreme Court ruling.
The SC ruling was in connection with the rank pay deduction in IV CPC and that's why MP 5&6 have said my query was BEYOND THE PURVIEW OF THE PRESENT CASE !
Any way let us wait and see the ensuing detailed instructions to be issued by the Govt.
 Till then WAIT and HOPE !

Dear Veterans,

Jai Hind.

The Government of India orders issued today are attached.

Those who retired before 01 Jan 1986, should read the letter carefully.

 

For grant of Rank Pay arrears the order does not make any distinction among officers who retired before or after 01 Jan 1986SO PLEAES RELAX.

 

Salary of all officers whether they retired before 01 Jan 1986 or after that date, will be revised upwards.

1.     Those in service on 01 Jan 1986, will get benefit of full rank pay till the date of retirement (corresponding to their rank on various dates) and half of the rank pay from the date of retirement till 31 Dec 2006.

2.    The officers who retired before 01 Jan 1986, will get half of the rank pay as addition to their earlier pension, starting from 01 Jan 1986, till 31 Dec 2006.

3.    For the revised pay in both cases the additional DA will also be added.

4.    Interest will be given only with effect from 01 Jan 1986. Rate of interest has not been defined in the Supreme Court order. It may be defined in the subsequent letter by the Government.

5.    Whether the income tax due will be deducted at source or you will have to pay later is not known at present.

 

For the well drafted GoI letter we need to once again thank Lt Col BK Sharma President RDOA and his Team Members of Retired Defence Officers Association.

Of course the credit also goes to the Three Service Headquarters who took Colonel Sharma in confidence while drafting this letter.

Of course the MoD deserves NO THANKS.

GOD will suitably look after all the Babus who are responsible for this gross cheating with the Defence Officers in the case of Rank Pay.

GOI & MoD have issued two letters for compling with the Supreme Court order.

Modalities for payment are being worked out for which seperate letter will be issued.

TRIPAS has been asked to fwd DGL immediately. Details of letter given

"In compliance of the Supreme Court order dated 4/9/12, I am directed to convey that GOI has decided to refix the pay without deduction of rank pay wef 1/1/86 in respect of the affected officers of the armed forces in conformity with the orders of the Kerela High Court order dated 5/10//1998" 

" Instructions regarding the modalities and methodology of payment to the affected officers of the armed forces and the provisioning of funds for the same are being issued seperately in consultation with Service Hqs, CGDA, Def (Fin) & MoF"
