SUBJECT: URGENT LEGAL SUBMISSION: Invocation of Supervisory Jurisdiction & the “Doctrine of Superior Responsibility” for Systemic Non-Execution of 47+ Binding Judicial Decrees by GNIDA Spanning 26 Years – Mahesh Mitra vs. CEO, GNIDA
Respected Sir/Madam,
a) Please find enclosed herewith a comprehensive Formal Representation Letter submitted by the undersigned, Mahesh Mitra (Petitioner-in-Person / Decree-Holder), seeking urgent judicial and administrative intervention in the matter of Mahesh Mitra vs. Chief Executive Officer, Greater Noida Industrial Development Authority (GNIDA).
b) The enclosed representation details a grave and protracted instance of institutional defiance, wherein a statutory authority has willfully, deliberately, and systematically failed to execute over 47 binding judicial and quasi-judicial orders spanning 26 years, despite a final decree by the Hon’ble NCDRC dated 30.05.2014 mandating plot allotment/possession within 90 days.
c) The persistent non-compliance, coupled with suppression of material facts, unilateral dilution of decree terms by executing forums, and closure of execution proceedings per incuriam, constitutes a blatant violation of Articles 14 & 21 of the Constitution, the foundational Rule of Law, and the statutory enforcement mandate under Sections 72, 75 & 76 of the Consumer Protection Act, 2019.
d) Crucially, this submission invokes the recently established “Doctrine of Superior Responsibility” laid down by the Hon’ble Allahabad High Court in Avnesh Kumar Agarwal vs. Union of India (decided 03.06.2026), which expressly mandates personal, administrative, and in appropriate cases, criminal accountability of senior officers for systemic dereliction, suppression of records, and contempt of judicial orders. The representation further seeks.
e) Time-bound execution of the NCDRC decree, including physical possession and registered allotment of the 2,500 square meters. industrial plot at the original rate of ₹750/- per square meter.
f) Activation of a structured monitoring mechanism per the Manish Kumar Singh (2023) compliance framework.
g) Initiation of contempt proceedings under Section 12 of the Contempt of Courts Act, 1971 & Section 75 CPA, 2019;
h) Personal accountability affidavits from the CEO, GNIDA, and senior administrative heads for over a decade of institutional inertia.
i) In light of the Supreme Court’s reiterated observations in Palm Grove Cooperative Housing Society Ltd. and Rahul S. Shah vs. Jinendra Kumar Gandhi that judicial decrees reduced to “paper orders” collapse the very architecture of justice, your esteemed office is respectfully urged to take urgent cognizance, direct immediate listing/consolidation of pending execution proceedings, and issue appropriate supervisory directions to restore judicial efficacy and constitutional accountability.
j) The enclosed representation is submitted for your kind perusal and necessary directions. I remain available to furnish certified case records, execution filings, or additional affidavits as may be required.

Justice must not only be done but must also be seen to be done; in the present matter, the petitioner has been facing continuous injustice, oppression, and acts of terror at both judicial and administrative levels for years, wrongs that are clearly evident.
