You should not have paid him BEFORE he sent the work to you. What should have happened what that the freelancer sends the completed work to you and then sends you an invoice. You have a certain amount of time to look over the work and/or test it out. IF you are satisfied with the results, then and ONLY then should you release the escrowed funds.
At this point, not you, or Upwork can "force" this freelancer to give you the work, or even return the money to you. Even if you start a dispute and take it all the way to arbritration, and it's determined you should get the work no one can force the freelancer to give that to you. So, starting a dispute is a waste of time.
Osama, the proper thing for a client to do when a freelancer cheats him, or when a freelancer in any way is not a good fit for the project, is to stop working with that freelancer completely. Do not work with that freelancer again in the future.
In all cases where a freelancer cheats a client, a client may report the freelancer to customer service if he wants to. Doing so can help the Upwork community as a whole. But you are not obligated to file a report if you don't want to.
It really sounds like you did not work with a project manager, nor were you qualified to act as the project manager. So, by default, the freelancer was the project manager. That was a mistake. You let the fox guard the henhouse. Next time, work with a qualified independent project manager.
Upwork does not seem take into regard that any real life client/ freelancer or B2B relationship is human and you build a certain kind of trust. Especially because Client is not technically averse and therefore can easily get duped by unscrupelous developers that take advantage of this fact. This does not happen in real life and in technical side the human aspect seems to get completely disregarded.
I have a similar situation, though not as bad. However, towards the end it became bonafide extortion: freelancer tells me that either you pay me weekly and I choose my own timing or I will not deliver the final part also ( for which he already received the money, because he did not expect it to be so much work, and its the end of the month and he has to feed the family, etc). It seems these sites are filled with people who have no sense of dealing, contracts, business and think they are in a 9-5 job (probably got fired from there) where they work couple of hours a day but want to be paid like a business.
there are lot of things that should not be done in dealings but if it were that simple than there would not be 100s of complaints and disputes here. The problem is not the Clients releasing funds too early. There are many factors why someone would release funds before hand. Like in my case I released full funds but openened additional smaller milestone as the freelancer duped me through technical aspects that the coding requires more sophisticated work. So there are far more intricate factors. And let me tell you I am a Businessman and have seen all sorts of tricks in my life, but I look who I work with. And in the first place I was working with Upwork and its legal terms, which de facto state they are the partners of these freelancers out which now mine according to Upwork turned out to be a known scammer.
So it is very much that this is absolutely the legal incrimination knowinlgy or unknowingly of upwork by being in complicit action. Starting with the fundamentals rule no 1. to verify the accounts and the freelancers, who apparently are posing with different identities. And keep changing their pictures because they rely on it that most people would not come back onto this site after having been scammed!.

Because then you would have chosen to use an hourly contract, and there would be no money tied up in escrow. Or you would have used a fixed-price contract, but with a small milestone. Instead of $350, you would have started with just $15 for the first step. An amount you can afford to lose. If after that you saw that the freelancer's work is not good enough for your project, you could release the money and end the contract and be done with that underperforming freelancer.
Fair enough, trusting escrow blindly has put me in this exhausting scenario. your kind advice is noted and I would be following it the next time I use Upwork to hire a freelancer. Might as well move away from hiring freelancers altogether, now that the pandemic is under control in the place I reside.

Just like companies, freelancers could also have many leads/inquiries coming in about projects. I remember one of my projects where it took nearly 3 weeks just to sign a contract for 20 days of work. There are instances where people called me to check my availability and then got back after 10 days, asking if I could start working immediately.
We understand that companies have a lot of formalities and standard internal procedures to assign a contract to someone. But this delay occurs mostly with companies that begin their project-planning after they find a freelancer to work on it. That is, if a company receives a new requirement from a client for which it does not have the expertise, it starts looking for freelancers that specialize in the relevant domain. Once it identifies one, it starts discussing the project with the client.
Have a small conversation with your freelance vendor in your free time, wherein you dig deeper into their past work experiences, specializations, interests, and more. This will give you an insight into how to make the best use of their skillset for your requirement.
Having too much communication is also not recommended. It will reduce the efficiency of the freelancer, while inadequate communication will lead to assumptions that can cause irreparable damage. At regular intervals, inquire about how things are with regards to work; and if everything is going as per the plan. Also, do not forget to ask if they need any help.
At the same time, keep the freelancers informed about any updates on the project, which includes your conversation with the client and your team about any major changes in the project. Keep them informed on when they can expect to receive the feedback on their deliverables.

Maybe shot somewhere and he heard it (the game sometimes can do weird things, like you throw a coin to distract a nearby NPC, but a different one comes from 3 floors down).
Or trespassed maybe, or something else and he chased you all the way down to the lab, there he saw you commit a crime and gunned you down
I was in my scope for a second. I was not seen a single time in the level and was very careful. I scoped in, took the shot, killed my target, scoped out and he was in my vision to the left and shot at me. I should have made a clip but i forgot it in the moment. I went through the entrance on the clif and took out silently the two guards overlooking the lab from the eleveated position in the cave. I made it through the whole villa without being seen, spoted by a camera or a body found. I know that the AI does weird things sometimes. I played the WoA trilogy for houndred of hours, but this was the first time something like this happened.
That doesnt make sense either. I did not leave a weapon anywhere in the whole level. It was not an alerted territory map. I picked up every pistol from every guard i knocked out. The only way he could have come to my postion was if he followed me through the clifside entrance with a keycard considering i did not force open any door. And i dont understand what you mean with changing it to freelancer. Freelancer is a part of Hitman 3
He was in a Hawaiian shirt and wifebeater. Looked like one of the guards at the villa entrance. Another thing that might have happened that one guard at the garden above the lab did hear my surpressed pistol shot which took out a guard before i got to my sniping position. Would be very random tho.
