I think we can never hurt by asking Jason for his opinion...even though I often disagree with him.  It gives us some cover in everything we do.  I also have to check the rules: do we have a fine schedule that goes past a 3rd offense?  She may be willing to take 2 fines if she can keep on smoking.  I will check the rules, but I think the fines should double after the third, fourth, etc.

Hal?  Your thoughts on this?

The appeal process used by the other COA I am familiar with was for the owner to present, in person, the appeal before the board at an open board meeting. The overall Vaux process is essentially identical. I would expect the process used by Kin and us should be the same as theirs.

 

However ... the next board meeting isn't until mid-January. I think we need to act sooner than that. 

 

Should we ask Jason at VF for a recommended action: confronting an owner who continues to violate the rules while creating a nuisance and potential health hazard?

Personally I think we would be ill-advised to engage with 304 owners unless they ask for a hearing.

It is a clear violation of the Vaux By-laws and is also hazardous to our health.
