Hello, BODers —
Please take all discussion pertaining to vauxofficers or an actual meeting. This subject may prove consequential, and we should be minding our bylaw manners, I believe.

Subject: Re: smoking complaint #4, 10 Dec 25
I think we can never hurt by asking Jason for his opinion...even though I often disagree with him. It gives us some cover in everything we do. I also have to check the rules: do we have a fine schedule that goes past a 3rd offense? She may be willing to take 2 fines if she can keep on smoking. I will check the rules, but I think the fines should double after the third, fourth, etc.
Hal? Your thoughts on this?

The appeal process used by the other COA I am familiar with was for the owner to present, in person, the appeal before the board at an open board meeting. The overall Vaux process is essentially identical. I would expect the process used by Kin and us should be the same as theirs.
However ... the next board meeting isn't until mid-January. I think we need to act sooner than that.
Should we ask Jason at VF for a recommended action: confronting an owner who continues to violate the rules while creating a nuisance and potential health hazard?

You may be right. There is a medical issue here though and that gives another level of urgency to this. Crazy how one person can cause so much trouble.

I understand their frustration but there is protocol to which we need to adhere. It seemed to me that Amanda and Kin jumped on the violation pretty quickly and a fine is being issued.
Personally I think we would be ill-advised to engage with 304 owners unless they ask for a hearing.
Best
Taking Joy and Chris off of this. Tim, can we ratchet up the heat here? Joy is allergic to smoke. We gotta stop this.
Suggestion: face to face meeting with ALL owners of 304. Kin? Board? Both?
Thanks

I am registering a complaint, today, about cigarette smoke—again--in the hallway of third floor, Savier, coming from Unit 304. This is separate complaint from the one I registered on Dec 7, which was after several complaints in November.
At this point, I am growing frustrated at this situation, which does not seem to be changing. I would like to know what action, if any, Kin Living and the Vaux COA Board is taking or plan to take. I don’t think any of us at this end of 3rd floor, Savier, should have to deal with this situation over and over again. It is a clear violation of the Vaux By-laws and is also hazardous to our health.
Thanks for your attention to this matter.
