STAR INCONCLUSIVITY: Anambra Gubernatorial Results in Some Details


My People:

The long-awaited conduct of this Anambra Gubernatorial Election  on Saturday November 16, 2013, was tawdry, even by INEC's admission. Of the 1,770,125 registered voters, only 451,826  or 25.53% were accredited, and of which 421,052 or 23.79% of the registered voters were valid (16,544 rejected).  However, due to wide-spread irregularities, the polling in 208 Polling Units spread over 14 Local Governments with a total registered voters of 113,113 were cancelled, and now have to go to Supplementary Elections at a date uncertain.

However, the results declared so far are as follows:

 - Obiano of APGA: 174,710 (won in 16 LGs), which is 9.87% of registered voters, and 38.67% of the accredited voters.
 - Nwoye of PDP: 94,956 (2 LGs)
 - Ngige of APC: 92,300 (2 LGs)
 - Ubah of LP: 37,446 (1 LG)
- Ezeemo of PPA: 5,096 (no LG)

Therefore, both Nwoye and Ngige can still overtake Obiano in terms of total voters if all the 113,113 were added to their votes, albeit not in the LGs count.  Consequently, the polling is inconclusive, and, according to INEC, there is need for supplementary polling at a date yet to be announced.

However, INEC cannot and should not, as it has done prematurely and mistakenly,  announce a run-off between just Obiano and Nwoye, since Ngige is still very much mathematically in the electoral mix.

And there you have it.....however way you dice it, it was a very bad day at the office for INEC in Anambra on Saturday.

CALL FOR CANCELLATION OF ANAMBRA STATE
GOVERNORSHIP ELECTION
         
We, Senator Dr. Chris Nwabueze Ngige, Dr Patrick Ifeanyi Ubah and Comrade Tony Nwoye, candidates of All Progressives Congress (APC), Labour Party (LP) and Peoples Democratic Party (PDP) respectively, hereby call for the total cancellation of Anambra State Governorship Election held on the 16th Nov. 2013.

We are making this clarion call for total cancellation of the election because it was marred by gross irregularities emanating from:-

1.    Gross manipulation of the Voters Register leading to disenfranchisement of thousands of innocent voters

2.    Illegal removal of result sheets, doctoring of the said result sheets and massive removal of ballot booklet and thumb – printing of the said ballot papers

3.    Harassment and intimidation of Polling Agents and voters by security officials and party thugs

4.    Use of Voters Registers in some Local Government Councils different from the Voters Registers made available to candidates

5.    Late arrival of electoral materials

6.    Manufacturing of results in many polling units where no voting took place

We are of the candid view that the sham election does not reflect the wishes and aspirations of Anambra voters.

Our call for the cancellation of this election is reinforced by the public admission by Professor Attahiru Jega, the INEC chairman that some INEC staff sabotaged the conduct of the Election.

This call for the cancellation of the Election would have been unnecessary if INEC had postponed the conduct of the election after becoming aware of the sabotage of the election by INEC officials

Sorry...that is precisely the problem.  It is eyes needed here, not ears.

Moving on.....

Ngige won in two local governments (Idemili North and South), Nwoye also won in two (Dunukofia and Oyi), and Uba won in Nnewi North.  If you add 113,113 
to either Ngige's vote or Nwoye's vote, they each overtake Obiano in TOTAL VOTES but not in LG number of wins.

The Electoral Act requires you to do both in the first round: win BOTH total votes AND LG votes (with some riders).  Otherwise, there must be some run-off
between the two MOST prospective candidates. In this instance, there is little to choose between Nwoye and Ngige in terms of votes, so neither of them
can really be disqualified in terms of a run-off.

QUOTE 

Section 179 of 1999 Nigerian Constitution

179. (1) A candidate for an election to the office of Governor of a State 
 shall be deemed to have been duly elected to such office where, being the 
 only candidate nominated for the election- 
 (a) he has a majority of YES votes over NO votes cast at the election; 
 and 
 (b) he has not less than one-quarter of the votes cast at the election 
 in each of at least two-thirds of all the local government areas in 
 the State, 
 but where the only candidate fails to be elected in accordance with 
 this subsection, then there shall be fresh nominations. 

 (2) A candidate for an election to the office of Governor of a State shall 
 be deemed to have been duly elected where, there being two or more 
 candidates - 
 (a) he has the highest number of votes cast at the election; and 
 (b) he has not less than one-quarter of all the votes cast in each of 
 at least two-thirds of all the local government areas in the State. 

 (3) In default of a candidate duly elected in accordance with subsection
(2) of this section there shall be a second election in accordance with 
 subsection (4) of this section at which the only candidates shall be - 
 (a) the candidate who secured the highest number of votes cast at the 
 election; and 
 (b) one among the remaining candidates who secured a majority of votes 
 in the highest number of local government areas in the State, so 
 however that where there are more than one candidate with a majority 
 of votes in the highest number of local government areas, the 
 candidate among them with the next highest total of votes cast at the 
 election shall be the second candidate. 

 (4) In default of a candidate duly elected under subsection (2) of this 
 section, the Independent National Electoral Commission shall within seven 
 days of the result of the election held under that subsection, arrange for 
 an election between the two candidates and a candidate at such election 
 shall be deemed to have been duly elected to the office of Governor of a 
 State if - 
 (a) he has a majority of the votes cast at the election; and 
 (b) he has not less than one-quarter of the votes cast at the election 
 in each of at least two-thirds of all the local government areas in 
 the State. 

 (5) In default of a candidate duly elected under subsection (4) of this 
 section, the Independent National Electoral Commission shall within seven 
 days of the result of the election held under that subsection, arrange for 
 another election between the two candidates to which that sub-paragraph 
 relates and a candidate at such election shall be deemed to have been duly 
 elected to the office of governor of a State if he has a majority of the 
 votes cast at the election.

And there you have it.....it is a fine mess that we have in our hands, Ndi-Anambra!

I do not see the mathematics that puts Ngige in the running with just 1 LGA win. Is the number of LGA won not part of the calculus here? What percent of LGA counts must state governors win to be victorious? I am all ears.

Thanks for the update. The issue at hand, I believe,  is not the unpreparedness of INEC but the corrupt system that keeps manifesting itself in the polity. 
We still have a long way to go if democracy is to flourish in this country. INEC must brace up regardless the challenges. No challenges are insurmountable. 
The general elections in 2015 must not be what had taken place in Anambra. The leadership of INEC must pull up their straps and redouble their efforts so that the rest of the world will not jeer at us.

Most of the Officers in INEC are agents of  political parties, strategically planted over the years to do the bidding of the party in power either at the state/federal levels. Unless these guys are identified and rooted
out of  office, Nigeria may never witness any free and fair elections, even if you have an Angel as INEC Boss.

Suspicion has become the order of the day in our polity, based on our collective previous experiences. However, with the figure above, whatever happen to Nwoye happen to Ngige. It will amount to double standard to pick Nwoye and drop Ngige for possible run-off election. The problem still boils down to the mode of appointment of the Commission members. Each set of the  political appointees end up recruiting the candidates of their god-father that made the appointment possible. The idea of INEC staff of other states conducting an election in a state is not a bad idea, I think that was part of what made the 2011 Election better than others. The ECOMOG approach.

Many Nigerians are sick and tired of the refrain that the "system is corrupt". Systems including electoral systems are neither self-generated nor self-generating. They are the constructions or contraptions of critical persons. The do not exist and function outside the intent and control of critical persons- especially their operators. Each country's system is conceived, designed, and operated (controlled and managed) by critical persons.  Is it therefore the system or critical persons that is/are corrupt? If these persons are corrupt, the system will function as it is conceived, designed, and operated to do. Let the people and not the system be blamed. If a system is to change, its critical persons must change first. Corrupt systems are choices. Nigeria can choose different systems than she has so far. Whether or not she will is the question.
