Dear Jatin,

This spreadsheet simply lists out the names of the persons and the projects, for which the individual has obtained court orders for refund, against Unitech, and subsequently notified to Amicus. And the amount of money paid to Unitech. This is still not a final list, and subject to further reconcilations.

However, as per the Supreme Court orders, these names will be considered for the initial pro-rota refund disbursement. Remember Unitech has still not been able to deposit the entire money required for refund to all buyers asking for refund (let aside the interest component).

One additional point is that the current set of names in the spreadsheet are for those who have received orders from any court. I understand they will be given preference in terms of disbursement on pro-rota (not sure whether this is entirely true, since I have not seen the latest SC order yet. So in case you have anot got any court order, your name may not appear here.

Hi Satyashis,

I have uploaded all documents on Amicus website however my name is still not there in the refund list and as per the conversations I could understand that this refund list is only for people who have got the court orders. Is there any way, we can also have the court orders for getting the refund as we are struggling and not getting any kind of information or help to get this done.

Dear Mr. Naresh,

To obtain court orders you have to first file a case in the consumer court. Depending on the progress of your case, it may take up to several years to get a judgement. I had undergone court proceedings from 2015 and obtained my judgement in late 2017. When I handed over the documents to Amicus, for advance receipt of refund, it was very clear that they were specifically looking for court judgement, as the first priority, for refund.

Hi Satyashis

I am buyer of Unitech verve flat . We  got the judgement in our favour . It provided us with  compensation Plus registration of flat by Unitech by paying full  cost of Registration . It also put the condition  that delay in registration would be penalised @ 5000 per day . In the last hearing , NCDRC     postponed the case  sine die as per directions of Supreme court . The claim was above 50 lacs for delay in registration

Hello Mr. Prem Swarup,

Advise you to go through the Amicus Curiae website/portal https://www.amicusunitech.in/HomePage.

There is a new Govt. appointed Unitech board, which has submitted a Resolution Framework for all Unitech projects in India. The resolution framework is uploaded in the website above and Amicus is requesting for suggestions, by 9th August. In summary, the resolution framework proposes that no refunds will be given, instead flats would be handed over for possession, in a timebound manner, depending on the projects.

Just to add to the above, the no refunds is applicable to all, irrespective of whether that person has got a judgement or not. Even in case of judgement in favor, and also if partial refunds have been given, that money has to be returned back. Please go through the resolution framework in detail and submit your suggestions to Amicus by email. Last date is 9th August 2020.
