I  request  to all  to give their consent for sending the letter  to Unitech . Corrections  can be  made before sending. 
 
I also request Mr Jatin   to send  it on our behalf  after  corrections

Since we are going to legal route ultimately , we must seek opinion of lawyer  on what is right  process  to strengthen  our case.  As suggested , we should submit  a individual letter asking for  increase in rate of interest   and  refund  with interest   etc  and contents of the letter .

Couple of other points that comes to my mind. Let us have views on
this -

1. Do we have confirmation from Unitech regarding the 15th meeting and
who all are attending from their side?
2. Do we need to prepare any letter to Unitech with our demands? This
letter should be given to them either during the meeting or later. Any
such letter should have the registered owners name/ signature & flat
numbers. If, we agree on this we need to start praparing a draft for
this. Getting signatures from oversees friends/ outside Delhi using a
scan copy may take a bit of time.
3. These correspondences will help when we go for any legal action.

Do we need to attach the list of owners with their signatures expressing their consent and authorization?

If yes, how we can take the signatures

 

We should also strive to take the written acknowledgment for receipt

am comfortable with this... my only suggestion is to leave increased
penalty... say Rs 15 as a open option on 15th oct... cnt be there in
person but ny support to everyone

 Group seems to lack direction. Some  one should coordinate and lead . I am not sure who is taking action for 15th Oct meeting .

I have talked with Mr. Harsh and he has agreed for 15 th oct meeting
at time 10:30 am.
I had a word with Mr. Sinha as well and he has also agreed to meet but
he said that he will not meet with the whole group but only a single
person. May be one of us can meet him.

Request you all to make plans for 15th oct meeting.

I request  you to take the lead  in meeting with Mr Sinha . In my  view  , minutes  should  be drawn up   &  signed   as  Unitech can no longer be trusted  to stand on their  oral  commitments  .  We must know view of  Unitech on increase in penalty for delay in handing over the flats .
 
One may see some other  gentleman meeting you next time  with new commitments  .

Unitech is imposing erroneous conditions for the meeting. When all members have given payments and have valid bookings with them why are they afraid to meet the group as a whole and here we are only talking of a few (single digit) civilised representatives. Or is there an ulterior motive to this, to create deliberate apprehension between members. We should not give in to this, at least three representatives should go in discussion with Mr. Sinha. That should be the absolute minimum.
Actually they are not doing us any favours, but we are by listening to them and all in good faith.

I agree. Preferably, we should be a critical mass of representatives
from our side for meeting with Sinha. Otherwise, It is highly likely
that Sinha may call some of his people in the meting and that will
outnumber the single rep we send. We need to have some weight on our
side too.

Alternatively, why can't Sinha join the same meeting that we are
having with Harsh. If the meetings are separate, they will keep
refrerring to other guy (like last time) and try to buy time.

Looking at unitech response, If it is up to me I would not go into the meeting without legal representative along with fellow members. It seems they are not coming to this with good intent, hence putting pre conditions, but still worth giving them a chance.
I agree with Mr. Sarkar that all relevant should be in one meeting, otherwise little will be gained.
As for costs associated, let me know my contribution and the account number, I will transfer it immediately.
I will go with majority decision.
I would urge all members to forward their viewpoints at the earliest, so a consensus can be formed.

Let us give a final chance to Unitech to come clean with their side of story or offer on Oct. 15th and we must also advise Unitech of our intenstions of legal actions. This way they can not come back and say we never warned them of our intensions or consequences they may have to face.
 
I am willing to divert any funds that may be necessary for the legal action.
 
Please keep us posted.
 
Does anyone knows if any work is being done at the site. Any progress?

Are we still planning to meet Unitech reps? I have not heard of any agenda or points of discussion for meeting that is suppose to be held on Oct. 15th.

Had brief word with Mr. Chaturvedi today, he says slow work on site which means to me status quo. He could not give any assurance on when work will commence full swing to meet March deadline but only that things will become clearer end October. Does this relate to project specific decision or general legal complexities that unitech is involved in I do not know.
The group members meeting on 15th perhaps can get a better feedback.
For me it means choosing between sweating it out or a legal recourse I.e. a choice between the devil and the deep blue sea. Not a pretty site when you are starting a devil in the face. Whatever the group decides will go with it.

I had re-confirmed with Mr .chaturvedi today for our meeting on 15th oct. Meeting is ok with him .We will have discussion with Mr. Chaturvedi and Mr.Sinha first and then we will move on to see the unitech verve site.
 
As far as way forward is concerned , I am for taking on the legal course . Atleast I will feel that I have given a fair try.We are only fooling ourselves by listening to the fake promises of unitech representatives.
 
As per my discussion with Mr.Kshitiz there is no need for taking a lawyer with you. The case will be filled because of one-sided termas & conditions of the builder buyer agreement and for non-fulfillment of the terms laid down in the Agreement.
 
Please come one and Please come all for the fun filled saturday
