Конституційний Суд України розгляне справу сумлінного відмовника

Цивілізовані держави поважали свободу совісті навіть під час світових воєн і домовилися поважати її надалі, щоб ніколи знову не сталося такої війни. Сподіваємося, Конституційний Суд України врахує це, коли за скаргою сумлінного відмовника від військової служби Віталія Алексеєнка перевірятиме, чи є конституційним покарання ув’язненням від трьох до п’яти років за ухилення від призову під час мобілізації громадян, релігійні переконання яких несумісні із виконанням військового обов’язку (сумлінних відмовників), а також вимоги до віруючих доводити в суді свою невинуватість в ухиленні від призову, відсутність альтернативної невійськової служби під час війни та її недоступність для осіб, які не належать до привілейованих релігійних організацій.

Constitutional Court of Ukraine will hear conscientious objector’s case  

Civilized states respected freedom of conscience even during world wars and decided to respect it in future, so never again such wars could happen. We hope the Constitutional Court of Ukraine will take it into account when considering on merits the complaint of conscientious objector to military service, Vitalii Alekseienko, checking alleged unconstitutionality of jailing for three to five years for draft evasion during mobilization those citizens whose religion or beliefs are incompatible with the performance of military duty (conscientious objectors), and checking also alleged unconstitutionality of requirements for believers to prove in court their innocence in evading the draft, the absence of an alternative non-military service during the war and its inaccessibility to persons who do not belong to privileged religious organizations.
