Wednesday, Kate's taking Melissa back to University[1] and since
Emily's car failed it's MOT I am dropping her at work on my way.
Approaching here

we're bimbling along between 40 & 50 as the car get to the junction
where the driver looks right/left/right and still goes. Emily reckons
she gave us 20m to stop in, I don't really know other than it wasn't
enough. Anchors hard on, front starts to go at which point the car
appears to stop it's manoeuvre now effectively blocking both sides of
the road. So my view looks similar to

more braking, inevitable happens and the front tucks under. The bike
goes into the front of the car and Emily and I hit the road. Slither,
slide, crunch. When the world stops moving I get up[2]remove my helmet
and go to see to Emily. She's conscious, lots of scrapes on her
leathers and the knee seams gone leaving her with a nasty gash on her
left knee.

About 15 seconds after getting to her I realise that I've also damaged
myself. The difficulty when breathing, speaking or focusing being a
bit of a clue. At this point I manage to call Kate on the drivers
mobile before having a bit of a lie down. It's all a bit confused
until the ambulances turn up after 40 minutes, so if you ever plan on
a heart attack avoid rural Sussex. All our gear is cut off, we're onto
spinal boards and away to hospital.

I've got cuts and scrapes, a broken rib T4/T5 and my helmet looks like

in hospital, the gash was down to bone and she may have damaged her
cruciate ligaments, an MRI scan hopefully today[3] will prove that one
way or the other. She's due to go to University at the end of the
month, I am hoping that she can still get there although I suspect
she'll be on crutches for a while.

Sussex police turned up during Wednesday in the hospital and
apparently the drivers already told them that she didn't see us[4].
She'd said as much to me, but by admitting to the police it will
hopefully make the insurance claim less delayed than it otherwise
might have been.


[1] Hence using the Zafira, leaving me with her empty car or the bike.
[2] Possibly not the best thing to do in the circumstances.
[3] Should have been yesterday but she got bounced off the queue.
[4] 1/4 ton of red bike, with lights and my lardy carcass.

That's utterly, utterly crap. I hope you're both back to normal as
quickly as possible.

Being involved in a bin with a pillion must be one of the most horrid
biking moments. I hope to never have to be a part of one.

I do wish you both well and hope for a large insurance payout for both
of you.

Was nearly speared off myself the other day by an old boy who looked to
be about 100. He wore thick, blue, corrective specs and had his gaze
fixed rigidly ahead. It was a biiig roundabout with good viz and every
other cunt managed to spot the hulking outline of me, atop a fugly
R1200RT with matching luggage, with the World's Most Annoying Headlights
[1] ablaze.

He even had his window down which allowed me, by virtue of my wearing my
flip lid, to bellow "OI! YOU BLIND FUCKER!" at him from about 6 feet
away. Didn't bat an eyelid.

I can't see either of us making it at the moment. I am not sure when
Emily will get out of hospital or how mobile she'll be. I've been told
6 weeks or so until I can drive / ribs stop aching.

From the pictures I've seen no. Auntie Carol are going to give me 1st
crack at the salvage value, I figure it will be worth more to me that

I slid on oil with a mate as pillion sometime around '77 but that
wasn't bad. Bouncing my daughter down the road leaves me feeling
really guilty, she keeps telling me there was no way of avoiding it
but the guilt is still there.

My only off with pillion has been after looking at a new car, pulled out
into traffic then stopped dead as the dirty great Abus Granit U-lock
completed its revolution at the back of the forks. Had a great "What
the.." moment followed by toppling over.[1]

That seems to be the norm in Paris. The dozy cunts move over, without
looking or if they do, without looking properly. I don't know what it
is. I think it's a "I'm bigger than you, I'm moving over. Whether you

Somewhere around 62K, may have been just short of 63, I honestly can't
recall. That of course kills the value, whereas with a car it would be
normal mileage for the age.

Take pictures. I see you've got one, but get plenty. The scene from
both sides and both viewpoints (yours and hers); the approaches; the
road surface; any marks you may have left on the road; pics of your
damage, clothing damage and that to the bike. Do not throw anything
away - scraped lid, fucked gear - stick it in a box in the loft, 'cos
they may want to see it before they pay out on it.

Get pics of all your (and sprog's) injuries - and 'progress' pics as
you heal and the bruises change colour. Copies (or originals) of
X-rays can be useful too.

Seriously - the more ammo you have and the more angles you can cover,
the more likely they are to roll straight over.

When I had my WVM off, the assessor looked at the bike within a week
and I had the offer of the /full/ market value in two weeks. The TP
InsCo wrote to my insurers within two weeks taking full responsibility
and to me with a cheque for the excess at the same time - my NCB was
restored at that point. It's a good starting point, and the personal
injury claim was pretty much a formality after that - although I
dragged it out for my own benefit (six months of physio on the knee
started six months after the crash, for example).

My sincere commiserations to you both, but especially to sprog. Don't
let it put her off. The very best of luck, mate.

Be very careful. Some people try to slippery out of things later on;
make sure Sussex plod know you are making an accusation and you want the
case followed up on.

The lights are on, but nobody's home ...

I had one in wales, where I got the living bejeebers cut out of me on a
roundabout under the M4 (across no fewer than /three/ lanes, FFS! And in
the Shaguar, so hardly invisible), and ended up on the inside of said
gimmer, heading up the local dual carriageway. Despite being alongside
him, with both of us having our windows down, it took a /good/ 30
seconds of Bear Ordinary Unleaded Shouty Abuse to even make him look
around, and even then the blind & deaf twat looked in the wrong
direction.

You can't seriously tell me euthanasia wouldn't be a decent option.

Is it me, or are the roads suddenly much worse than usual? I found a
biker knocked off his bike the other day, surrounded by a gaggle of
people. I think everyone's going out in what they think may be their

Press the police very hard to prosecute.

This is not (simply) out of spite.

If the cage driver is convicted it simplifies your claim massively. If
she is not bet your donkey her insurers will try and lay some percentage
of teh blame on you. Its obscene, but its what they usually do.

If you have legal cover (and maybe even if you don't) select a lawyer who
specialises in this type of claim - plenty advertise in the bike press but
if anyone has specific recomendations fer him post now if you've not
already.

They should be well able to advise you on the finer points of their being
funded by your legal cover. If you don't have legal cover but are an RAC
or AA member they *used* to include this sort of support a sa freebie, now
they are trying to sell it ..... but ask anyway.

Glad you're both seem fundamentally OK.

Points to inclue in your own statement to the old bill include:

You're headlights were on.
You were wearing a high visibilty whatever.
You were driving well within the limit, saw her and slowed down but did
not brake as she appeared to look at you and you assumed that having seen
you she would behave correctly and not pull out.
You did not sound your horn until you saw her begin to move as it might
have been misinterpreted when she was not moving and have caused her to
think you were OK-ing her to pull out.

Heh. Some years ago I had a set of Kawasaki GT750 clocks for sale.
Perfect nick, all electronics working, and 94,000 miles on the
odometer.

The potential buyer sucked his teeth and muttered something about not
really wanting that sort of mileage showing on his bike, and I pointed
out that in a few months or a year, maybe, it would click over to 00000
again.

My daughter threw me off the back of her RM125 when she wheelied. I

I thought, in those circumstances, the ins co would cough up and then go
after her for re-imbursement?

There's some principle of insurance law involved, but I can't recall
quite what it is. Something about the ins co having to cover the risk,
and take it on the chin, else insurance becomes meaningless.

I know. I was chatting to my Ma about it the other night. There is *so
much* he needs to be told about... well, about just knowing when
somebody is going to do something silly.

Like:

When filtering up a line of stationary traffic, stay *right out* in the
other lane (oncoming traffic permitting) because someone *will* get
bored of sitting in the wueue and try to pull a U-turn. The extra couple
of feet give you better visibility and more room to maoeuvre.

In winter, watch for the exhaust plumes. The car's about to pull out
from the kerb, even though it hasn't indicated.

Just because the lights have turned green doesn't mean it's safe to pull
away. People jump the light often these days. Just check before going.

Gravel accumulates in the centre of junctions and is slippery.

Wet leaves are more slippery.

The geezer up there with steamed-up windows can't see you.

And more, and more and more. All the stuff you and I have learned over
the years, when the traffic was lighter and things less 'edgy'.

There's a really good article in Bike this month about risk and how good
aware riders are relaxed and their peripheral vision is taking in
everything and filtering it, and I thought (boasting apart): "That's how
I ride".

And I know he *will* crash because everyone bloody does.....

You could be right, particularly wrt injury, not sure about damage though (I
left the insurance industry years ago).

ISTR in such instances cover reverted to Road Traffic Act cover only, which
was basically only TP Injuries.

Even that's no guarantee of a speedy end to things. Some blind cunt knocked
my brother off his bike and was prosecuted for driving without due care (and
convicted). That was close on 2 years ago and although he's had "some"
positive response, the case is still plodding along at it's own pace.
Probably because the insco gave him a "courtesy" bike which he had for 7
months, thus running up a bill (to them) in excess of the cost of the bike.

The stupid cow never even told her insurance company that she'd been
prosecuted and convicted for the offense when her insurance came up for
renewal. Smart move THAT was.

Well he HAD a crap lawyer, so he changed and that's when things started
moving again. He got paid out for the damage to his bike, plus his injuries
(hip and pelvis), but the other fuckers insurance company are after him for
the cost of the courtesy bike they supplied (and apparently forgot about).

They won't get anything, but that doesn't stop 'em mithering. His new
solicitor is dealing with them now though, so hopefully, it'll die a death.

Unreal innit? I had this with the hole-in-the-leg injury a couple of
years back, which took /months/ to heal, and then again recently with a
cut (done with my ultra-sharp kitchen knife) that took about 3 weeks to
properly heal. I mean, FFS.

Will do, Emily's home with her leg completely plastered. She had a MRI
today and we're back on Monday for the results and to find out what
else she may need in the way of surgery/treatment. I'll get CIGNA on
the case if it will either improve the outlook or speed up her
treatment.

I'd just let the police and insurers get on with it in their own way
and only create if the insurers suddenly started throwing problems in
my direction.

Going running to the police and trying to create problems by
commenting on who was wearing glasses and who wasn't isn't something
I'd want done to me in the event of an accident so I'm fucking sure I
wouldn't do it to someone else.

Grr... Had a young kid do that to me in Canberra one night. I
pulled out of the parking spot on the T500R as he and his father reached
the central dividing line (30 feet or so from a ped crossing, IIRC). I
aimed behind them and opened the throttle. Little blighter (10? or so?)
heard the induction roar and exhausts of two 250 cc two-stroke cylinders
-- and ran back across the lane to his mother still on the kerb! All brakes
and squealing tyres I missed him somehow and through a quickly-rising
adrenalin fog screamed at him never, *ever* to run back the way he'd
come.

When I got home a few minutes later, shaking like a leaf, I
discovered my headlight was off...

I'd been filtering through traffic and was stationary waiting for the
oncoming traffic to sort itself. The car behind me decided to overtake
the line so it could turn right and nearly skittled me off.

I turned round doing the pointing at my eyes accompanied by various
mouthed 'opinions' [1] I then whacked open the throttle to get out of the
way straight into the path of a bus. Not at all cool and rufty tufty.


[1] Had I been a proper biker I would have gone back to the car and
raped the women; burnt down their houses and sold their children.
