Listed with BIN or BO. Got an offer, accepted it but no payment was
forthcoming. Had email exchange with buyer who said he would pay, have had
to start a dispute which is 'waiting for buyer response'.
If I relist this before the dispute is finished will I still get the fees
refunded or do I need to wait.

Had the same; a buyer who claimed they didnt know that clicking "enter
your best offer" (or whatever the terminology is) obligated them to
buy.
Got my FVF back by cancelling the transaction but lost my listing fee.
Will be closing my eBay account just as soon as they let me.

Why didn't you just report him as a non paying bidder and get fvf and
listing fees back.
It is quite clear that when you enter a best offer that you are
obligated to buy should the seller accept it.

and hasn't paid for that.
He left me good feedback for the first transaction so I am guessing he is
just a useless **** and am confident i'll get paid. Time of year doesn't

Because I was stupid enough to honour their request to cancel the
transaction.
It's called behaving decently.
Sadly, because eBay have removed my right to neg the buyer (they didnt
even respond to the dispute) I'm out of pocket, hence one less eBayer
just as soon as I can.

If you set an auto accept level, I believe you can then make it immediate
payment required.
