Valid Paypal claim?

I suppose I should have known better but . . .

I ordered an overcoat from here: http://www.tailor4less.com/uk/man/coats

The measuring instructions given on the website (complete with
diagrams and pics) were METICULOUSLY followed and treble checked.

When the coat arrived it was very nice - but too small! Every
dimension was about two inches off. After again checking all the
measurements it suddenly became obvious what had happened. All of the
measurements were made as depicted on the website (i.e. wearing a
shirt). But an overcoat is meant to be worn "over" something -
usually a suit jacket - and allowances must be made for the bulk of
the jacket. Nowhere on the site is any mention made of taking the
measurements whilst wearing a jacket or otherwise compensating for the
greater dimensions required to accommodate the jacket.

To complicate matters, the operators of the site can't communicate
very effectively in English.

I feel that the Seller must bear some of the responsibility for this.
I am not a tailor and I should have the right to trust the
instructions given by those with much more experience. Yet I do
understand that common sense might have had a place in this exercise
as well.

Any observations/opinions would be welcome.

Have you asked them to honour their "Perfect Fit Guarantee"?
"We guarantee a perfect fit If alterations are needed, we pay* for them."

Your claim is not a valid one as you got what you ordered. Paypal
will not refund if you ordered the wrong size as that is down to you.
It is your error and not down to anyone else to advise you.
If you do not know how to buy or order clothes to fit, you should
ask for some help from a friend. The seller is not at fault and you
need to accept they supplied what YOU asked for, so get over it.

Yes, I got what I ordered. Can't disagree with that. BUT - my order
was incorrect directly due to the inadequacy of the instructions on
the vendor's website. How do you think that the seller is not at
fault? I didn't knowingly order the wrong size. According to the
seller's own instructions, I ordered the correct size. If I had not
followed the instructions and the item didn't fit, would I have been
similarly at fault? Or if the seller's instructions had said "Due to
the cut of this garment add three inches to each actual measurement"
and it was too big, would I be at fault.

Reading through the Returns policy on their site, it would appear you
have a very good cause for complaint. To quote their own terms under the
heading 'Refunds and exchanges':

> Customer has to bear in mind that measures introduced in their profile

> the garment, our tailor will determine your measures. Therefore, body
> measures cannot be compared with garment measures in order to identify
> possible deviations.

It clearly states that the measurements entered into your profile are
taken from your body size not clothes sizes. Their tailors then use
these to determine the correct size for the clothes. It almost sounds
like they assumed you had carried out the measurements while wearing
clothing and had reduced them accordingly.

I can't help thinking this is not going to be an easy situation to
resolve if they are based in Hong Kong.

The clothes appear to be tailored in HK but the correspondence and the
payment came from/went to Germany.

At this point I'm not sure what they have offered me.

"Dear Michael,

we have checked your case and we compared your measure with the
ordered measures.

The result is that your sleeve length measure (23 inches) and shoulder
measure (18 inches) were correctly applied.

Therefore, we offer you to pay instead 180€ only 35€ for a new coat
with the same fabric. This offer you give the possibility to modify
and review your coat measures.


We hope that is a proper solution for you."


It looks like they are sticking to the "you got what you ordered" line
and not even a word about the inadequacy of their instructions. Are
they saying they will give me another coat for 35 euros or they will
give me 35 euros to have the coat altered?

They appear to be saying they will make you a _new_ coat (of a different
size) in the same materal for 35 Euros.
