Ebay trying to charge FVF for stuff that doesn't sell

Had a message from a punter after auction had finished looking for a cheaper rice so messaged him with my telephone no and Ebay gave a warning that if I sent the message They would charge me FVF even though their was no suggestion I was selling or had sold the item.

Legally this seems dodgy and not fair

how do theyget away with it!

Seems fair to me - they introduced you to a buyer, you pay the
commission that you agreed to in their terms and conditions.

They were charging me for sending an message with my number I was 90% sure no deal would be done as most don't deal outside ebay due to risks I only sent it on the of chance that a deal could be done if I relisted the item but my price was way higher than he was willing to pay.

many sellers post their tele number in there ads so their attitude does not achieve much
