underage porn spam, what to do?

most (all?) uk based news services are sorted about underage
porn thanks to the IWF and the efforts of responsible ISPs.
this is good.

my problem, which I would like people to think about, is what to
do about *spam* to an otherwise "decent" newsgroup that includes
images that are probably illegal in the uk and elsewhere.

most of the images in the group are of women with small breasts
(big and particularly artificial breasts do not turn me on so I
don't look for them) but someone is spamming illegal (in the uk)
images to the group. I don't want the group to be taken away
but how can I stop the spammer of illegal images?

usenetserver.com provide no trace info and claim at
http://usenetserver.com/
"Anonymous access and posting"

the site being advertised is silly-teens.com which a whois
provides a real address in Pittsburgh, Pennsylvania, USA.

what should I do? usenetserver.com don't provide a trace ...

Have you done the obvious, and used the info in these headers to
complain:

X-Complaints-To: ab...@usenetserver.com
X-Abuse-Info: Please be sure to forward a copy of ALL headers
X-Abuse-Info: Otherwise we will be unable to process your
complaint properly.

I imagine that the images in question are likely to be as illegal in the
country in which Usenetserver is based as they are here, so that there
is a good chance that they will take action if you explain the basis of
your complaint.

So you _have_ spoken to them, then? If they are saying that they can't
identify who posts through them, it's rather pointless - even
disingenuous - for them to insert those headers.

that is what I saw as the problem. they're getting money from
them posting so they don't seem to care

i will write to them tomorrow. my confusion was because i
thought people that made child porn hid it away rather than
advertaising it with spam. i still don't understand it.

It apears that your worryed about that site virginphotos.com if you
look way down on the bottom of the page it states that all models are
18yo or old so dont sweat it.

virginsphotos.com not virginphotos.com although they also say on
the website that models are 18 or over. but some of the usenet
posts that are advertising the site are definately not over 18,
so the site might be OK but the spam is not. up to the IWF now

There is a class of "child porn" images - a large one - that are illegal
in the UK but legal in the USA and, probably, many other countries.

Is the difference publicly available somewhere?

I haven't looked at every bit of the IWF site recently (so it may be
there and I just didn't find it) but I can't see anything saying "don't
report this sort of stuff because it is OK in merka if it comes from a
merkin"

The OP was obviously confused and it would be good if there was a
resource for him (I presume a him) to know what he should report.

the US position is encapsulated in the Supreme Court ruling in the case
of Ashcroft v. Free Speech Coalition (No. 00-795, April 16, 2002)

the UK position is in the Protection of Children Act 1978 s1 (as
amended) [with the amendments being especially relevant, since the
important matter is whether the image is of a real child]

the IWF will still process reports of illegal material even though it is
hosted overseas and legal overseas -- in practice, they just ensure that
it is removed from Usenet servers in the UK, or if web based they add
the URLs to their database (as used by various blocking solutions)

In section 2(3) (evidence) and section 7(6) [of the PCA 1978]
(meaning of "child"), for "16" substitute "18".
