I am puzzled by this extract

Is anyone familiar with this case? It says the defendant had taken
pictures of the child when it seems to me she took the pictures of
herself and sent them to him. Is this bad reporting or has he been
prosecuted for "making pictures" in the same way that someone who
downloads child pornography is?
