G'day all,

Please could anyone give me more information about the case of Wadsworth
v Glesby? I would like to gain a basic understanding of the case, because
it is being quoted against me as a precedent for mitigating the liability
of a driver who injured me in a motor accident.

For starters, if someone can give me a date and/or Court for it then that
would help immensely.

I'd ask my solicitor, but he seems to have forgotten what the thing on
his desk with numbers and a handset is for. :-(

TIA, Nick.

Are you referring to Wadsworth v Gillespie [1978]?

A misleading signal case it appears.

The case was "distinguished" in a more recent case: Soils Ltd v Bromwich
[1998] where it was held that the major road driver was not going slowly
enough for the emerging driver to reasonably have relied on his intention to
turn left given the nature of the road at that point.

The cases are in the Current Law yearbooks

Given your description, it sounds like I am indeed referring to Wadsworth
v Gillespie. Sounds like an error in dictation.

Thanks for the information, you are a prince among men.
