Hi all
I have a non molestation order against another member of my family which ran out last week. I did apply for an extension but the case was not heard as no one turned up for the hearing (I'll get back to that).
Now that it has expired can anyone tell me if I have to start the application from the beginning or can I go through the application for the extension again?

Now for my rant! A couple of days before the hearing they sent me a letter stating a time and date and the name of the Judge, nowhere was it mentioned that I was expected to attend, (as it happens I was away and couldn't anyway) but I can't believe in this day and age the the Court's communication is so unclear, they really need to get up to date!

Anyway, I'd be grateful for any help, I don't want to employ a Solicitor just to answer a question.

Thanks

Brendan.

AIUI if you were applying for the order the Court would require you to
be there. The Court would, AIUI, expect that to take priority over any
other arrangements you might have made.

Brendan, I think that you may be underestimating how difficult it is to
get a non molestation order extended. It is not just a rubber stamping
exercise. So, even if you had turned up, it might not have been granted.

The Catch 22 seems to be: if the family member abided by the order then
things have probably calmed down and he/she should not have his freedom
impeded for longer than needed. So, you may need a solicitor in order to
make a successful application. Or to convince you that you can't.

And I would have given it priority if I had known but the short notice caught me out.
