Is anyone aware of the rule that says if six people or more request an
allotment, the Council have a duty to provide one?
Here it is! "By Section 23 of the Small Holdings and Allotments Act
of 1908 is made the express duty of every Local Authority, except
County Councils, who are of the opinion that there is a demand for
allotments in their area, to provide a sufficient number of them and
then to let them to persons resident in the area.
By way of providing a democratic means of bringing to the notice of
the council (the Allotment Authority) a need for allotment gardens
that may be considered to exist the Act further requires that the
Authority must take into consideration any representations in writing
made to them by any six registered parliamentary electors or
ratepayers resident in the area, to the effect that the circumstances
of the area are such that it is the duty of the Allotment Authority to
provide allotment gardens."
According to the National Society of Allotment & Leisure Gardeners,
Woking has 188 people on waiting lists for allotments, and their lists
are closed. Is this a way around?
