Churches, 501(c)(3) Status, and Free Speech

Many, if not most, churches operate as 501(c)(3) non-profit organizations, which provides them with tax-exempt status from federal income taxes. This status also allows donations to churches to be tax-deductible for contributors, encouraging financial support. Foundations and grant programs often require this determination letter before providing funding, and it assures donors their contributions are tax-deductible.

Historically, the Johnson Amendment, enacted in 1954, barred all 501(c)(3) non-profits, including churches, from endorsing or opposing political candidates. This meant that religious leaders could not explicitly endorse or oppose political candidates from the pulpit or through official church channels without risking their tax-exempt status. Churches operating under 501(c)(3) status are generally prohibited from influencing legislation and political campaigns.

In 2025, the IRS announced a policy shift, following a settlement from a lawsuit involving two Texas churches, allowing churches and religious organizations to endorse political candidates from the pulpit or during a worship service without losing their 501(c)(3) tax exemption. This ruling was seen by some as restoring a component of free speech that had previously been restricted for a segment of the Christian church, while others raised concerns about the implications of political endorsements within religious contexts.
