The problem is that you are using ffmpeg from libav.org not ffmpeg.org.
(not too mention an old version of tovid) For now libav.org is
shipping both an ffmpeg AND avconv binary, but the ffmpeg behaves a
little bit differently than ffmpeg.org's since it uses the libraries
from libav.org.

As timing would have it I am about to commit some changes to SVN that
adds support for avconv and libav.org. I'm pretty busy the next couple
of days, but will probably do it by Friday or Saturday. If you are able
to wait and try it out it would be a great help in testing it.

Let me know.

cheers,
Robert

I have no issue with trying on Friday or Saturday.  As a side note, the creation of the disc works fine if I choose add the no menu option.

Let me know how you wish me to run this when you have the new update.

Hi Terry,
Did you get a chance to try the new version I emailed you ? In any
case, this is just to let you and others know it has been committed to
SVN along with a few other things, so you can update and take advantage
of the libav.org support (avconv).

If you or others could give feedback on this it would be helpful.

all the best,
Robert
