Hello all! :)

Wondering if anyone on the list who is a home/property owner into urban agriculture has ever applied to Agricorp for Farm Business Registration, specifically with the Farm Property Class Tax Rate Program in mind??

(I'm thinking of Zawadi Farm and Neighbours Feeding Neighbours as possible models of backyard growers who might fit the bill??)

Anyways, if anyone has experience with this in an urban context, would appreciate learning more.

Hi Sean,

 

The short answer is yes, you can get the property tax rebate and we did for one of our properties and are in the midst of applying for the second. Here’s how:

 

  1. Apply for a farm premises ID from OMAFRA. Register here: https://www.ontariopid.com/en-CA/
  2. Setup your account on the MPAC website. A couple of hoops to jump through to setup your account and you’ll need an initial access code, so best to call MPAC and they can give you your initial code over the phone (1-866-296-6722)
  3. You can then apply for a request for reconsideration online. The key here is to have lots of backup that you’re actually farming the land. I sent pictures, my website, farm premises ID number tied to the property, income tax returns showing farming classified income.
  4. Legally they have 180 days to first respond to your request, but we heard back from an agent within a month. There was some back and forth, mostly educating them on what urban farming is and validating that we were actually farming.
  5. We got approved about 120 days after submitting and then submitted to Agricorp for the rebate, which we expect to get in 2024.
  6. There is no limit to the number of properties you can attempt to reclassify.
  7. This does not change any zoning, nor does it require zoning approval
  8. MPAC will calculate the percentage of your property being used as farmland and change the property tax amounts for just that portion of the property. In our case, 88% of our property qualified as farmland (small house, massive lot), and we will pay the standard residential property tax rate on the remaining 12%

Sorry, I should also mention you can do this as a tenant farmer as well. You just need the property owner to do this work for you, and there’s a form to fill out for agricorp as a tenant farmer.

My wife and I own a 50 acre farm in Grey County, and our farm has a Premises ID and a Farm Business Registration number.
The FBR is tied to the business, the Premises ID is tied to the property. Agricorp bills us annually for our FBR number, we are obliged to pay $300 annually to either the Ontario chapter of the National Farmers Union, The Ontario Federation of Agriculture. or the Christian Farmers Federation of Ontario. (We are proud members of the NFU). 

If you run a farm business and make more than $7000/year you must apply for an FBR number, and you are then eligible for reduced property taxes on most of your farm property excluding what they call "the residential complex," defined as the primary residence and 0.5 hectare (1.2 acres) of the property. So, you pay full residential mill rate on the first 1.2 acres and 25% on the balance of the property.

Here's where it gets weirder.

Congratulations, you now live on a working farm. When a working farm is sold, the sale of the property is subject to HST. The buyer and seller together, before closing, are to agree to a value of the "residential complex (house and 1/2 hectare)," and a value for the balance of the farm property.
The portion of the property that is not the residential complex is subject to HST. As both the buyer and seller have HST accounts, the seller is not required to collect HST at closing. The buyers fill in the HST owing on their next HST return (line 205), and claim the same amount back as an input tax credit (line 107), resulting in zero HST payable.
The sellers do the opposite.

An HST account is not required if you make below $30000 a year in farm income, but you may start with HST at any level of sales.
Once you have an HST account, you have the ability to claim back the HST on items purchased in the operation of our business.
Broadly, farm produce is "zero rated" (no HST), but you must charge HST on value added products from your farm business.
I have attached the relevant legislation. Any questions on HST can be answered by the HST Rulings office, (800) 959-8287.

Now that you have a property with a Premises ID and a Farm Business registration number, some of the proceeds of the sale of your farm may be considered capital gains, and you may be subject to income tax in the tax year that you sell your farm.

Albino Penis Envy shrooms can be best described to look like a normal Penis Envy shroom, except smaller and blue. In most cases, these are considered novelties more than anything and are a smaller subset of the bigger mushroom family, Psilocybe cubensis.

Uncut Penis Envy Shrooms
The Uncut shroom has a head that does not spread out. The caps don’t open at all and remain closed or almost closed to the stem.

These shrooms are supposedly the strongest of all the Penis Envy varieties. Other variations include the Trans Envy and Texas Penis Envy.

Trans Envy
The Trans Envy variety is a cross between Penis Envy and Transkei mushrooms. They display some physical characteristics of both, possessing thicker stems than typical Transkei mushrooms, with the pale caps of the Penis Envy variety.

Their potency level also seems to be somewhere between the stronger Penis Envy mushrooms and slightly less intense Transkei mushrooms.

You can grow a Penis Envy mushroom quite easily in the right temperatures with a grow bag and mycelium substrate. An entire batch can sprout in about two months, give or take a couple of weeks.

By the third or fourth week, you can expect fruiting to already take place, with your mushrooms growing by the day. The indication for a complete fruiting cycle is when your substrate or cakes turn blue, which means that the Penis Envy mushroom has fully grown.

Make sure to collect the few mushroom spores that your batch will produce. It won’t be much, in fact it’s going to be less than five percent of your shrooms that give you those goodies. With that, spore prints are also expensive and hard to find. Using a growing kit as mentioned here would be the most convenient way to cultivate your own Penis Envy shrooms.
