Recently my husband was released from Seg at one unit and shipped to another unit.  He is eligible for parole as a Line 1, but he is being kept at the G-5 level by the warden even though Huntsville recommended 1. when he was released from the former unit he was recommended to be released into medium custody level and as a G-4.  Another committee was held just a week ago and again Huntsville recommeneded that he be moved to a G-4 level, but the Warden made the decision to not do this but keep him at a G-5 level.  I know my husband is guilty of deeds he should not have done, cell phones, but he has not had a case in almost two years, and his file had been pulled to look at for parole review, but he caught a case while on the chain for altered appliances which he tried to explain to the officer that those were applicances replaced at the other unit by officers and he has papers but they are in his property which he has not recieved after being at this new unit over 2 months.

My question and hope is that can someone advise me where do we go from here?  I visited last weekend, talked with a major who told me that even tho my husband is eligible to go up for parole again in April or May, they won't even look at him due to him being a G-5.  This has me very upset and afraid and not knowing where to turn or what to do....its like he is doomed according to this Major.

If Huntsville recommends an action, why is it not followed and how do I and where do I go to find out about all of this?  We tried to fight the altered appliance case asking for it to be at least put into a minor case, but they won't budge.....its major all the way.  We have contacted Ombudsman's office, called the unit, faxed letters to the unit, talked to different departments.

No one cares, plain and simple.  The new unit is very professional and nice, but as the Major told me, this is the strictest unit in TDCJ and that is why your husband was sent here.

He is serving a 17 1/2 yr sentence for aggrivated robbery.  His time started Aug 31, 1999.

Thanks for any help........if you prefer to help me with private email, then I will send you mine.

OK. It is not true that he cannot be paroled from G5. There are hundreds of men paroled each year from ad seg. The big thing is the major case. If he loses class or good time as a result of that, he will not be reviewed. AND, if he is in a lower good time earning category than he was when he first entered the system, he will not be reviewed.
Fight the case. If you don't win, do all you can to get a good parole packet for his next review. Actually, the unit recommends promotions and demotions and Huntsville recommends. I find it difficult to understand what you are saying - that Huntsville, or the State Classification Committee, recommended a promotion and the unit, or the Unit Classification Committee, refused. It's the other way around. I'm wondering where you got that information.
Good luck.
