Today, the Housing Alliance is in Olympia with hundreds of housing advocates for Housing and Homelessness Advocacy Day.  Together, we are standing up for polices and investments that will help ensure more people across Washington State have the opportunity to live in a safe, healthy and affordable home and that our communities have the tools and resources they need to prevent and end homelessness.

Affordable housing is the foundation of a healthy, stable life.   A child’s ability to learn in school is greatly impacted by whether or not they have someplace to go home to.  In December 2010, the Washington State superintendent reported that more than 21,000 school children were homeless during the last school year.  Today, housing advocates in Olympia will hear from students and staff from Tacoma’s McCarver Elementary school.  This school has created a partnership with the Tacoma Housing Authority to address a turnover rate during the last school year of over 120% (after a 100% turnover, students who joined mid-year were not able to stay till the end of the school year thus pushing the rate to over 100%).  Together, the school and housing authority are working to bring stability and security to families so that their children can get a solid education.

This week in Olympia lawmakers will again be given the opportunity to help move important housing legislation forward.  The Fair Tenant Screening Act -HB 1526- is being heard in the House Judiciary Committee on Wednesday at 8:00 AM and two bills are scheduled for an executive session this week -HB 1768 and HB 1707- that are critical to ensuring the continuation of many programs central to preventing and ending homelessness.  See the yellow box on the right for a complete list of the bills scheduled for action this week.  The first cutoff is just one week away, so all bills have to clear their first committee by Monday the 21st in order to have a chance of passing this session.

Take action today to ensure that critical programs to prevent and end homelessness are not cut. 

Contact your representatives to tell them to vote yes on HB 1768 and HB 1707.  Both are scheduled for executive session this week in House Committee on Community Development and Housing.   Click here to email your elected officials today or call 1-800-562-6000 to leave a message like this, “Please support HB 1768 and HB 1707.  The programs funded through these bills are crucial in ending and preventing homelessness.”


Background on Operations and Maintenance and the Home Security Fund:
Operations and Maintenance and the Home Security Fund are two of the most vital tools available in our efforts to alleviate homelessness. Because they are funded through document recording fees, resources for these programs decrease in just the kind of economic environment that increases the need for these critical efforts.

The Home Security Fund supports the Emergency Shelter Assistance Program, serving over 47,000 people each year, the Transitional Housing, Operating and Rent (THOR) program, which serves over 3,000 families with transitional housing, the Independent Youth Housing Program, which serves 198 youth aging out of foster care, and Housing Grant Assistance Programs which gives grants to support innovative approaches to ending homelessness in counties across the state.  The Operations and Maintenance Fund ensures that Housing Trust Fund homes are affordable to Washington’s lowest income residents. 


The Gap:
At the end of the 2011-2013 biennium, the Home Security Fund will be short by at least $12 million.  If the $20 increase is allowed to sunset, the gap will nearly triple to $32m in the 2013-2015 biennium.  Without additional revenue, the amount available in the Operations and Maintenance Fund will drop from $8.6m in 2010 to $4.8m in 2011 and down to $2.5m in 2012.  All funds are already committed. A reduction of this size will lead to a loss of affordable units for people earning the lowest incomes.  Take action today to help prevent cuts to these programs.

Wondering how other states are mobilizing around budget cuts and attacks on public sector workers?  Wisconsin teachers and union members have staged several days of peaceful protests at their state capitol and have captured attention from around the world.  Friday’s Democracy Now started their program with an in-depth interview.  Listen or watch it here.


A large group of committed and talented advocates worked throughout the interim on the Fair Tenant Screening Act.  With incredible dedication and vision, these folks spent countless hours crafting language and strategies to pass a solid bill that would protect vulnerable tenants and eliminate barriers to housing.

Live in the 47th LD? 
At 6:00 p.m. on February 23, households across the 47th Legislative District will receive a phone call from Senator Joe Fain (R-Auburn) and Rep. Pat Sullivan (D-Covington).  Those who pick up will be invited to participate in a one-hour telephone town hall during which they can learn about the current legislative session and share their thoughts and questions with the bi-partisan team of legislators.
Only those with land lines will receive a phone call, so those wanting to participate via cell phone can call toll-free 877-229-8493. The ID code is 15428. The number will be available about ten minutes before the town hall begins.

Consider participating and speaking up about an important housing and homelessness issue.  For example, “I’m very concerned about the lack of affordable housing in my community and I hope that you will support a new investment in the Housing Trust Fund.  The Housing Trust Fund produces housing for those who need it most, while producing jobs and stabilizing our community.”

Last week started with optimism and determination when over 500 affordable housing and homelessness stakeholders traveled to Olympia early Monday for Housing and Homelessness Advocacy day.   Fueled with encouragement from Representative Kenney, who shared that she had experienced homelessness herself, advocates from 46 of our state’s 49 legislative districts met with nearly 100 elected officials.  Many shared personal stories to educate and embolden their elected officials to support the policies and investments that can move our state closer to a place where everyone has the option to live in a safe, affordable and healthy home.

Senator Murray, 43rd Legislative District (Seattle), chair of Senate Ways and Means Committee, meeting with constituents Monday at Housing and Homelessness Advocacy Day.  Constituents discussed the Housing Trust Fund, The Fair Tenant Screening Act, Disability Lifeline and more.

Last week also brought the first cutoff of the session, which resulted in one of the Housing Alliance’s top legislative priorities dying in the House Judiciary Committee.  Although the Fair Tenant Screening Act, HB 1526, received a hearing on Wednesday, the bill was not given the vote needed to pass it out of committee.  Despite incredible testimony from tenants and advocates, the bill is dead for the session.  Senator Kohl-Welles went to great lengths last week to create a Senate vehicle for this bill and deserves our thanks.  Unfortunately, the Senate version introduced by her, SB 5826, also died due to a lack of a hearing.

Not all the news was bad however, with many important housing bills moving forward.  See the chart below for updates on all Housing Alliance priorities and the bill tracker at the end of this email for details on many of the bills impacting affordable housing.  One significant highlight is the continued progress of the foreclosure mediation bill, another Housing Alliance top priority.   Both the Senate version – SB 5275/Kline – and the House version – HB 1362/Orwall – moved out of their committees of origin and are on track to keep moving.  The progress of these bills represents significant negotiations between all stakeholders, including advocates and banks.  Bruce Neas of Columbia Legal Services deserves a special shout out for his excellent hard work.  Advocates from across the state have been calling their elected officials to tell them that now is the time to implement a mediation option for homeowners and it is helping to move these bills along.  Continued advocacy will be needed, so stay tuned for future alerts.

The details on the foreclosure mediation bill amendments:

It is the House version that represents the most current agreements between stakeholders and it is anticipated that the Senate will also incorporate these amendments.  The most significant difference from the original version is that now a homeowner needs to contact a housing counselor or attorney in order to trigger the mediation. The amendments in the House version also:
1) Add many new foreclosure housing counselors, 2) Put parts of the bill under the purview of the Attorney General, 3) Limit the bill only to beneficiaries that have more than 250 foreclosure trustee sales per year, meaning it would not apply to most credit unions and community banks and, 4) Implement a $250 fee on notices of default that will be paid by the lender.  This fee will cover all costs of enforcement of the bill, will pay for education to the public about the program, and will also pay for many more housing counselors across the state.

The House bill extends the ”meet & confer” timeline to sixty days.   If a homeowner responds within 30 days after first being contacted, they are then given sixty days from the date of contact to deal with their lender or servicer to negotiate a different outcome.  If they are not getting a response, they can evoke a right to mediation, but this must be initiated by an attorney or by a housing counselor. The housing counselor/attorney can trigger mediation on behalf of the homeowner at any time up until the notice of trustee sale is issued. If mediation is triggered, then a mediator must be named within 10 days and then the mediation must take place in 45 days.


If this bill passes, Washington will become one of three non-judicial foreclosure states* to implement mediation protections.  


*Non-judicial in this context means that the foreclosure process in Washington does not require the courts to be involved.   A little more than half of all states (27) are non-judicial, with judicial states requiring some oversight and involvement of the courts.


The Tacoma News Tribune on Friday gave some attention to the progress of these bills.

This week starts with a work session entitled an “Overview of state investments in low-income housing” in Senate Ways and Means at 3:30 today.  Affordable Housing experts will be testifying and discussing how the Housing Trust Fund, the State’s primary tool to invest in affordable housing, has produced more than 36,000 affordable homes in 38 of Washington’s 39 counties for Washington’s most vulnerable residents.  Watch the work session here and click on “live programming” or “media archives” and simply search to find today’s Senate Ways and Means committee hearing.  You can also watch the testimony on SB 5645, a top Housing Alliance support item, which is also being heard today in that committee.

Thank you to everyone who came out for Housing and Homelessness Advocacy Day and to everyone who has already taken action this session to stand up for affordable housing and for an end to homelessness.  With about two-thirds of the session left before us and many important policies and investments on the table, please pledge to take action at least once a week through April 24th – the last scheduled day of session.  Elected officials have very tough choices still before them and affordable housing and homelessness advocates can help ensure that policies and investments are passed that move Washington forward.
