Dear Neighbors,

A few neighbors have expressed concern about increased rental activity in our neighborhood and expressed an interest in adding rental restrictions to our covenants.  The purpose of this email/survey is to solicit your opinions regarding adding a rental restriction clause before starting a formal and tedious process to make such a change.

The primary concern regarding rentals is the perception that renters do not take the same pride and responsibility as home owners in maintaining yards and houses causing a general deterioration of neighborhood curb appeal.  There is also a concern about the transient nature of renters that chips away at the cohesiveness of the neighborhood.  

On the other hand, adding a rental restriction may reduce the marketability of a home, especially in bad times.  It may also be perceived as encroaching on home owners property rights since these restrictions are being added post facto.

Please note that to add a rental restriction clause to our covenants, we will need a positive consent of 2/3 of the  home owners.

If a rental restriction is agreed to and passed, it  would limit the number of houses that can be rented out at any given time. Once that number is reached, further requests are placed on wait list until existing rentals are either sold, stay vacant for more than specified amount of time or withdrawn.  Requests are handled in the order they are received with any tie breakers decided by lottery. We will also need to “grandfather” any existing rentals. Depending on the limit, there may be a wait-list from the start due to this.

I encourage everyone to vote, I am personally in favor of rental restrictions however I understand we have to have a majority vote. The survey took me less than a minute

Just a clarification on the legality of these restrictions. It is legal to add such a restriction. See #8 at this link : http://www.luederlaw.com/restricting-leasing-through-amendment/
We are a POAA association.

Just because it is legal does not mean we have to do it and that is the purpose of this survey.

Hi Sarat,

I am generally in favor of rental restrictions. The reason being is that renters come and go, and therefore the cohesion of our neighborhood is diminished; also, renters might be less respectful of the quality of life we enjoy here, since they know their housing is temporary. So the real question to me is what rules to make up in order to have "good quality" renters. Maybe have a restriction on the monthly rent amount needing to be above a certain percentage of the current market home value, such as 0.75%

Just some thoughts to get the conversation going and try to find a good solution for everybody.

Thanks for the comments.  You bring up good points.  However, we must be mindful of anti-discrimination laws (Equal Housing Opportunity etc) that can be triggered by trying put provisions for “quality” renter.  I am not sure if it is appropriate for HOA to even try to do that.  

 

I think free-market will take care of the rental amounts pretty efficiently.

 

Also, we need to remember that HOAs recourse is against the owner and not the renter.  Several survey respondents already mentioned that we may be a little lax in enforcement and perhaps an increase is what is neeed, which will ultimately force the owners to select right tenants.
