I have not seen your response to the issues raised by Andrea below.  The matters that he raises are important and warrant immediate action from the developer.  It is particularly important that the management of the court is representative of the owners, and the developer cannot continue managing the apartments  by excluding the management company/owners.

 

I was at the apartments last Sunday, and in addition to what has been raised, the state of cleanliness at the court leaves a lot to be desired.  There was litter all over the compound.  At the swimming pool area, the seats were lying all over and the pot flowers and garden were unattended to and in disarray; in fact the pot flowers dried up a long time ago.  The play area is also unkempt.

 

But most disturbing of all is the garbage bins next to the gate.  The rubbish once deposited inside the garbage house is strewn by wild cats who spill the waste outside of the garbage house.  The garbage house is unattended to and the smell is awful (when were these last cleaned?).  The doors to the garbage areas do not close, thereby allowing the littering.   This issue in particular needs to be attended to urgently, otherwise there will be no difference with the slums.  The doors need to be redesigned with openings at the upper side , to allow people to deposit the rubbish without littering the surrounding area and the cats scavenging the rubbish bags.

 

Please urgently arrange for a stakeholders meeting to address these issues among others and map out the way forward on the upkeep and maintenance of the apartments.

The service levels at Thompson are not acceptable, and the developer continues to hold on to the property management and act as if he still owns the property, the owners & the developer are headed for a collision course. 

 

It's becoming apparent that the only reason the developer refused to hand over the property to the owners was to advance "Thompson 2". "Thompson 2" is a separate entity and should not use the legal name, bank accounts or resources of Thompson Apartments Ltd.

 

It's apparent that the borehole is supplying water to the new development at the expense of the residents, the complex is being used to park heavy machinery used for that development next door & the sewer was directed through the property.

 

I had previously mentioned to you that as a ltd company Thompson needs to have audited financial statements, file statutory returns & hold AGM's annually. I still await your response

 

Please let your employer know that he needs to do the right thing, and do it now.

Thanks for the report.

It's apparent that we have an issue with service charge collection, the amount in arrears is alarming and reflects a failure on the part of the property management.

The owners had previously requested that the management be handed over from the developer, this is yet to happen. What is the status of that?

As a limited company, Thompson Apartments Ltd needs to file audited returns of our financial statements every year among other statutory obligations.
