Public Forum on the “Bin Abdullah” Decision of the Court of Appeal —
The Impact of Fatwas under the Federal Constitution (20 Sept 2017)
The Bar Council Constitutional Law Committee and the National Young Lawyers and Pupils Committee are organising a forum to discuss the constitutional issues in respect of the Court of Appeal decision of A Child & Ors v Jabatan Pendaftaran Negara & Ors (Civil Appeal No: W-01(A)-365-09/2016).
The Court of Appeal held that the Director-General of the National Registration Department of Malaysia had acted in excess of jurisdiction in adding “bin Abdullah” to the name of a child born out of wedlock, and refusing to add the child’s father’s name as a surname, against the mother and father’s wishes, based on two fatwas issued by the National Fatwa Committee in 1981 and 2003. The landmark ruling has resulted in intense discourse among members of the public as well as lawyers, Syariah scholars, and politicians.
The objectives of the forum are as follows:
(1) To critically analyse the impact of the fatwas on government bodies and the civil courts under the Federal Constitution; and
(2) To provide a platform for discussing arguments in support of, and against, the decision of the Court of Appeal.

The speakers for the forum are:
(1) Dato’ Seri Gopal Sri Ram, Former Federal Court Judge; Member of the Bar; and
(2) Dato’ Dr Ahmad Farouk Musa, Chairman and Director, Islamic Renaissance Front.
The forum will be moderated by Lim Wei Jiet, Co-Deputy Chairperson of the Bar Council Constitutional Law Committee.
