VẬN ĐỘNG NẠN NHÂN CỘNG SẢN VIỆT NAM TRONG NƯỚC VÀ NGƯỜI VIỆT TỊ NẠN CỘNG SẢN TẠI CÁC QUỐC GIA TỰ DO, DÂN CHỦ ĐỒNG KÝ TÊN YÊU CẦU TÒA ÁN TƯ PHÁP THÀNH PHỐ MONTREUIL, PHÁP XEM XÉT THÁO DỠ BỨC TƯỢNG HỒ CHÍ MINH.
Chúng tôi kính mong Quý vị quan tâm, xem xét và hỗ trợ việc tháo dỡ bức tượng Hồ Chí Minh đặt tại Montreuil, Pháp, trên cơ sở những quan ngại nghiêm trọng liên quan đến các hành vi bị cáo buộc là tội ác chiến tranh, tội ác chống nhân loại và các vi phạm nhân quyền nghiêm trọng trong lịch sử Việt Nam hiện đại.
Chúng tôi cũng kính đề nghị Quý vị xem xét thực tế rằng nước Pháp — một quốc gia dân chủ, pháp quyền, gắn bó với các giá trị nhân quyền, tự do tôn giáo và các nguyên tắc phổ quát — không thể làm ngơ trước những quan ngại sâu sắc của đông đảo cộng đồng người Việt tị nạn tại Pháp cũng như trên toàn thế giới liên quan đến việc tôn vinh công khai Hồ Chí Minh trong không gian công cộng tại Pháp.
Theo nhận định của nhiều nạn nhân cộng sản Việt Nam và các tổ chức nhân quyền, việc duy trì biểu tượng này có thể gây tổn thương sâu sắc đối với ký ức của các nạn nhân, đồng thời đi ngược lại tinh thần bảo vệ nhân phẩm, công lý lịch sử và các giá trị dân chủ mà Cộng hòa Pháp luôn đề cao.
Chúng tôi xin Quý vị nhận nơi đây lòng tri ân và sự kính trọng sâu sắc của hàng triệu công dân Việt Nam là nạn nhân của chế độ cộng sản Việt Nam.

Chúng tôi tin rằng việc bảo vệ Tổ quốc, bảo vệ nhân dân, bảo vệ tự do tín ngưỡng và tôn trọng nhân quyền là trách nhiệm chung của mọi công dân Việt Nam yêu nước, không phân biệt chính kiến, tôn giáo hay xuất thân.
Trước những vấn đề liên quan đến quyền con người, tự do dân chủ và tự do tôn giáo trong lịch sử Việt Nam, chúng tôi tha thiết kêu gọi sự chung tay của các luật gia, luật sư, nhân sĩ trí thức, tổ chức tôn giáo, đảng phái chính trị, các hội đoàn và giới truyền thông trong và ngoài nước.

Việc thu thập chứng cứ, lập hồ sơ pháp lý chi tiết, cũng như tranh luận và biện hộ trước Tòa án là trách nhiệm của các luật sư và chuyên gia pháp lý, bao gồm cả luật sư trong nước và luật sư người Việt tị nạn tại các quốc gia dân chủ như Pháp, Hoa Kỳ, Vương quốc Anh, Đức, Úc…

Nếu không đồng thuận, xin vui lòng giữ thái độ tôn trọng hoặc đưa ra đề xuất xây dựng nhằm tìm giải pháp pháp lý phù hợp hơn.
Chúng tôi kêu gọi tránh công kích, chia rẽ hoặc đối đầu nội bộ, vì điều đó có thể làm suy yếu nỗ lực chung và vô tình cản trở mục tiêu bảo vệ quyền con người và công lý lịch sử.

.......................................................................................Sau các cuộc biểu tình ôn hòa do các thành viên cộng đồng người Việt tị nạn chống cộng tổ chức tại công viên Montreuil, nơi đặt tượng Hồ Chí Minh, chính quyền địa phương đã tiến hành che phủ một phần và hạn chế việc trưng bày bức tượng này trong khi chờ xem xét về mặt pháp lý và hành chính liên quan đến yêu cầu tháo dỡ.
Các cuộc biểu tình này đã được tiến hành trong tinh thần hoàn toàn ôn hòa, tôn trọng trật tự công cộng và pháp luật của Cộng hòa Pháp, nhằm bày tỏ sự phản đối đối với việc tôn vinh công khai một nhân vật lịch sử mà nhiều nạn nhân, thân nhân nạn nhân, người tị nạn chính trị và thành viên cộng đồng người Việt hải ngoại cho rằng có liên hệ đến các chính sách và biến cố đã gây ra những vi phạm nghiêm trọng đối với nhân quyền, các quyền tự do căn bản và nhân phẩm con người tại Việt Nam trong thế kỷ XX.
Qua đơn này, chúng tôi kính yêu cầu Tòa án Tư pháp Montreuil xem xét lại việc duy trì bức tượng này trong không gian công cộng, trên cơ sở các nguyên tắc về nhân phẩm con người, ký ức lịch sử, sự tôn trọng đối với các nạn nhân và các giá trị dân chủ, cộng hòa của nước Pháp.
I. NỘI DUNG CÁC YÊU CẦU VÀ CÁC CÁO BUỘC
1. Về trách nhiệm chính trị và ý thức hệ
Theo quan điểm của chúng tôi và của một bộ phận lớn cộng đồng người Việt tị nạn trên toàn thế giới, Hồ Chí Minh là người sáng lập và lãnh đạo chính của hệ thống cộng sản Việt Nam, với sự hỗ trợ của phong trào cộng sản quốc tế thời bấy giờ.
Hệ thống chính trị độc đảng này đã dẫn đến, trong nhiều thập niên, những hạn chế nghiêm trọng đối với các quyền tự do dân sự, tự do tôn giáo, tự do ngôn luận và các quyền căn bản tại Việt Nam.
2. Về các biến cố lịch sử bị cho là cấu thành các vi phạm nghiêm trọng nhân quyền
Chúng tôi kính đề nghị Tòa án Tư pháp lưu tâm đến các biến cố lịch sử sau đây:
• Phong trào Xô Viết Nghệ Tĩnh;
• Cải cách Ruộng đất;
• Vụ án Nhân Văn – Giai Phẩm;
• Các chiến dịch gọi là “Xét lại chống Đảng”;
• Cuộc Tổng công kích Tết Mậu Thân 1968;
• Hệ thống trại cải tạo sau năm 1975;
• Các tranh cãi liên quan đến chủ quyền lãnh thổ và quan hệ với Trung Quốc.Theo nhiều lời chứng, tài liệu lịch sử, hồi ký của người sống sót và các thành viên cộng đồng người Việt hải ngoại, các biến cố này đã gây ra những tổn thất to lớn về nhân mạng, những xâm phạm nghiêm trọng đến nhân phẩm con người, tịch thu tài sản cũng như các vi phạm nghiêm trọng đối với các quyền tự do căn bản.
3. Về thời kỳ Xô Viết Nghệ Tĩnh (1930–1931)
Chúng tôi cho rằng giai đoạn này đã đánh dấu sự du nhập vào Việt Nam của một mô hình cách mạng dựa trên đấu tranh giai cấp, đi kèm với các diễn ngôn bạo lực nhắm vào một số tầng lớp xã hội, đặc biệt là giới trí thức, địa chủ và các nhóm bị xem là đối lập về ý thức hệ.
Theo phân tích của chúng tôi, định hướng chính trị và ý thức hệ này đã góp phần tạo nên một bầu không khí dẫn đến các vi phạm nghiêm trọng nhân quyền trong các giai đoạn sau đó.
4. Về Cải cách Ruộng đất (1949–1956)
Chúng tôi long trọng xác nhận rằng chiến dịch Cải cách Ruộng đất tại miền Bắc Việt Nam đã dẫn đến, theo nhiều lời chứng lịch sử, các vụ kết án tùy tiện, đấu tố công khai, tịch thu tài sản, giam giữ và xử tử thường dân.
Nhiều tài liệu và lời chứng khẳng định rằng chiến dịch này đã ảnh hưởng sâu sắc đến cấu trúc gia đình, sự cân bằng xã hội, đời sống văn hóa và nhân phẩm của nhiều gia đình Việt Nam.
5. Về các hành vi bị cho là cấu thành các vi phạm nghiêm trọng nhân quyền
Chúng tôi cho rằng nhiều chính sách và chiến dịch chính trị trong thời kỳ này mang những đặc điểm có thể được phân tích như các hành vi đàn áp có hệ thống đối với thường dân, bao gồm:
• Giam giữ kéo dài mà không có xét xử công bằng;
• Đấu tố công khai;
• Xử tử ngoài khuôn khổ pháp luật;
• Đàn áp giới trí thức, văn nghệ sĩ và các chức sắc tôn giáo;
• Hạn chế quyền tự do ngôn luận, tự do lương tâm và tự do tôn giáo.Chúng tôi kính đề nghị các sự kiện này được nghiên cứu và đánh giá dưới ánh sáng của các nguyên tắc luật nhân quyền quốc tế và các chuẩn mực quốc tế về bảo vệ dân thường.
6. Về sự phá hủy các giá trị truyền thống và đạo đức xã hội
Chúng tôi long trọng xác nhận rằng một số chiến dịch chính trị trong thời kỳ này đã gây ra những chia rẽ sâu sắc trong gia đình và xã hội Việt Nam, làm suy yếu các giá trị văn hóa, tinh thần, nhân bản và đạo đức truyền thống của dân tộc Việt Nam.
7. Về hậu quả đối với đời sống tôn giáo và văn hóa
Nhiều cơ sở tôn giáo, văn hóa và tín ngưỡng đã bị tịch thu, đóng cửa hoặc bị hạn chế hoạt động trong các thời kỳ cải cách và kiểm soát chính trị, gây phương hại đến tự do tôn giáo và đời sống tinh thần của một bộ phận người dân Việt Nam.
8. Về quan hệ lịch sử với Pháp trong thời kỳ Đông Dương
Chúng tôi kính đề nghị Tòa án Tư pháp nghiên cứu và đánh giá một cách khách quan các sự kiện xảy ra trong các cuộc xung đột tại Đông Dương, bao gồm các hành vi bạo lực, điều kiện giam giữ và cách đối xử đối với một số tù binh chiến tranh người Pháp, người Việt Nam và các đồng minh trong giai đoạn lịch sử phức tạp này.
II. CƠ SỞ PHÁP LÝ VÀ CÁC NGUYÊN TẮC QUỐC TẾ
Chúng tôi kính đề nghị Tòa án Tư pháp xem xét đơn thỉnh cầu này dựa trên:
• Hiến chương Liên Hiệp Quốc;
• Tuyên ngôn Quốc tế Nhân quyền năm 1948;
• Công ước Quốc tế về các Quyền Dân sự và Chính trị;
• Công ước Chống Tra tấn;
• Các nguyên tắc của Luật Nhân đạo Quốc tế;
• Các nguyên tắc về nhân phẩm con người và bảo vệ các quyền tự do căn bản;
• Các nguyên tắc châu Âu liên quan đến việc tôn trọng ký ức của các nạn nhân dưới các chế độ toàn trị.III. CÁC YÊU CẦU
1. Theo nguyện vọng chính đáng của hàng triệu người Việt Nam đang sinh sống tại Việt Nam cũng như của những người Việt Nam tị nạn cộng sản đang định cư trên toàn thế giới, chúng tôi kính đề nghị Tòa án Tư pháp vui lòng tiến hành xem xét lại việc duy trì tượng Hồ Chí Minh trong không gian công cộng tại Montreuil và, nếu thấy phù hợp, ban hành một quyết định hoặc phán quyết yêu cầu chính thức tháo dỡ bức tượng này, căn cứ trên các nguyên tắc về nhân phẩm con người, ký ức lịch sử, sự tôn trọng đối với các nạn nhân của các chế độ toàn trị cũng như các giá trị dân chủ và cộng hòa của nước Cộng hòa Pháp.
2. Yêu cầu mở các cuộc nghiên cứu, điều trần, tham vấn công khai hoặc các cuộc thẩm định lịch sử và pháp lý độc lập liên quan đến các sự kiện và biến cố nêu trên.
3. Yêu cầu Tòa án Tư pháp và các cơ quan có thẩm quyền quan tâm đến quyền lợi của các nạn nhân, những người tị nạn chính trị Việt Nam và các cộng đồng đã chịu hậu quả từ các chính sách cộng sản tại Việt Nam.
KẾT LUẬN
Chúng tôi kính đề nghị Tòa án Tư pháp xem xét đơn thỉnh cầu này trong tinh thần tôn trọng Nhà nước pháp quyền, bảo vệ nhân quyền, gìn giữ công lý lịch sử và tôn trọng các giá trị dân chủ của Cộng hòa Pháp.
Chúng tôi đặc biệt kính đề nghị:
1. Xem xét lại về mặt hành chính và pháp lý việc duy trì bức tượng này trong không gian công cộng;
2. Mở một cuộc tham vấn công khai với sự tham gia của:
– các hội đoàn người Việt có liên quan;
– các sử gia;
– các tổ chức bảo vệ nhân quyền;
– đại diện các chính quyền địa phương;3. Một cuộc đánh giá độc lập có tính đến:
– các nguyên tắc về nhân phẩm con người;
– sự tôn trọng ký ức của các nạn nhân;
– các giá trị dân chủ và cộng hòa của nước Cộng hòa Pháp;4. Xem xét thực tế rằng nước Pháp, một quốc gia dân chủ gắn bó với nhân quyền, tự do tôn giáo và các giá trị phổ quát, không thể thờ ơ trước những quan ngại do một bộ phận quan trọng của cộng đồng người Việt tị nạn bày tỏ liên quan đến việc tôn vinh công khai Hồ Chí Minh trong một không gian công cộng của Pháp.
Đơn thỉnh cầu này không nhằm kích động hận thù hay gây tổn hại đến quan hệ ngoại giao giữa các quốc gia, mà chỉ nhằm lên tiếng thay cho các người tị nạn chính trị Việt Nam và những người cho rằng họ đã phải gánh chịu hậu quả từ các chính sách cộng sản tại Việt Nam, trong sự tôn trọng pháp luật Pháp, châu Âu và các nguyên tắc dân chủ.
Kính xin Quý Tòa chấp nhận lời bày tỏ sự kính trọng cao quý của chúng tôi.

Nous prions respectueusement les autorités et institutions concernées de bien vouloir examiner et soutenir la demande de retrait de la statue de Hô Chi Minh installée à Montreuil, en France, au regard des graves préoccupations relatives aux actes qui lui sont reprochés, notamment des allégations de crimes de guerre, de crimes contre l’humanité et de violations graves des droits humains dans l’histoire contemporaine du Vietnam.
Nous demandons également qu’il soit tenu compte du fait que la France — nation démocratique, attachée à l’État de droit, aux droits humains, à la liberté religieuse et aux valeurs universelles — ne saurait ignorer les profondes préoccupations exprimées par une grande partie de la communauté vietnamienne réfugiée en France ainsi qu’à travers le monde concernant l’hommage public rendu à Hô Chi Minh dans un espace public français.

À la suite des manifestations pacifiques organisées par des membres de la communauté vietnamienne réfugiée anticommuniste au parc de Montreuil, où est installée la statue de Hồ Chí Minh, les autorités locales ont procédé à la couverture partielle et à la limitation de l’exposition de cette statue dans l’attente d’un examen juridique et administratif relatif à une demande de retrait.
Ces manifestations se sont déroulées dans un esprit strictement pacifique, respectueux de l’ordre public et des lois de la République française, afin d’exprimer une opposition à l’hommage public rendu à une personnalité historique que de nombreuses victimes, familles de victimes, réfugiés politiques et membres de la diaspora vietnamienne considèrent comme associée à des politiques et événements ayant entraîné de graves atteintes aux droits humains, aux libertés fondamentales et à la dignité humaine au Vietnam au XXe siècle.
Par la présente, nous sollicitons respectueusement du Tribunal judiciaire de Montreuil un réexamen du maintien de cette statue dans l’espace public, au regard des principes de dignité humaine, de mémoire historique, de respect des victimes et des valeurs démocratiques et républicaines de la France.
I. OBJET DES DEMANDES ET ALLÉGATIONS
1. Concernant la responsabilité politique et idéologique
Selon notre point de vue et celui d’une partie importante de la communauté vietnamienne réfugiée à travers le monde, Hồ Chí Minh fut le fondateur et le principal dirigeant du système communiste vietnamien, avec le soutien du mouvement communiste international de l’époque.
Ce système politique à parti unique a conduit, durant plusieurs décennies, à des restrictions significatives des libertés civiles, de la liberté religieuse, de la liberté d’expression et des droits fondamentaux au Vietnam.
2. Concernant les événements historiques présumés constitutifs de graves violations des droits humains
Nous demandons respectueusement au Tribunal judiciaire de porter attention aux événements historiques suivants :
• Le mouvement Xô Viết Nghệ Tĩnh ;
• La Réforme agraire ;
• L’affaire Nhân Văn – Giai Phẩm ;
• Les campagnes dites de « Révision contre le Parti » ;
• L’offensive du Tết Mậu Thân de 1968 ;
• Le système des camps de rééducation après 1975 ;
• Les controverses liées à la souveraineté territoriale et aux relations avec la Chine.Selon de nombreux témoignages, documents historiques, récits de survivants et membres de la communauté vietnamienne d’outre-mer, ces événements auraient causé des pertes humaines considérables, des atteintes graves à la dignité humaine, des confiscations de biens, ainsi que des violations importantes des libertés fondamentales.
3. Concernant la période Xô Viết Nghệ Tĩnh (1930–1931)
Nous considérons que cette période a marqué l’introduction au Vietnam d’un modèle révolutionnaire fondé sur la lutte des classes, accompagné de discours violents visant certaines catégories sociales, notamment les intellectuels, propriétaires terriens et autres groupes considérés comme opposants idéologiques.
Selon notre analyse, cette orientation politique et idéologique aurait contribué à créer un climat favorisant ultérieurement des violations graves des droits humains.
4. Concernant la Réforme agraire (1949–1956)
Nous attestons sur l’honneur que la campagne de Réforme agraire menée au Nord du Vietnam a conduit, selon de nombreux témoignages historiques, à des condamnations arbitraires, des dénonciations publiques, des confiscations de biens, des détentions et des exécutions de civils.
De nombreux documents et témoignages affirment que cette campagne a profondément affecté la structure familiale, l’équilibre social, la vie culturelle et la dignité humaine de nombreuses familles vietnamiennes.
5. Concernant les actes présumés constitutifs de graves violations des droits humains
Nous considérons que plusieurs politiques et campagnes politiques de cette période présentent des caractéristiques pouvant être analysées comme des actes de répression systématique contre des civils, notamment :
• Détentions prolongées sans procès équitable ;
• Dénonciations publiques ;
• Exécutions extrajudiciaires ;
• Répression visant des intellectuels, artistes et responsables religieux ;
• Restrictions à la liberté d’expression, de conscience et de religion.Nous demandons respectueusement que ces faits puissent être étudiés et évalués à la lumière des principes du droit international des droits humains et des normes internationales relatives à la protection des populations civiles.
6. Concernant la destruction des valeurs traditionnelles et morales de la société
Nous attestons sur l’honneur que certaines campagnes politiques menées durant cette période ont provoqué de profondes divisions au sein des familles et de la société vietnamienne, affaiblissant les valeurs culturelles, spirituelles, humanistes et morales traditionnelles du peuple vietnamien.
7. Concernant les conséquences sur la vie religieuse et culturelle
De nombreux établissements religieux, culturels et cultuels auraient été confisqués, fermés ou soumis à des restrictions d’activité durant les périodes de réforme et de contrôle politique, portant atteinte à la liberté religieuse et à la vie spirituelle d’une partie de la population vietnamienne.
8. Concernant les relations historiques avec la France durant la période de l’Indochine
Nous demandons respectueusement au Tribunal judiciaire d’étudier et d’évaluer objectivement les événements survenus durant les conflits en Indochine, y compris les actes de violence, les conditions de détention et les traitements infligés à certains prisonniers de guerre français, vietnamiens et alliés durant cette période historique complexe.
II. FONDEMENTS JURIDIQUES ET PRINCIPES INTERNATIONAUX
Nous demandons respectueusement au Tribunal judiciaire d’examiner cette requête sur la base :
• De la Charte des Nations Unies ;
• De la Déclaration universelle des droits de l’homme de 1948 ;
• Du Pacte international relatif aux droits civils et politiques ;
• De la Convention contre la torture ;
• Des principes du droit international humanitaire ;
• Des principes de dignité humaine et de protection des libertés fondamentales ;
• Des principes européens relatifs au respect de la mémoire des victimes des régimes totalitaires.III. DEMANDES
- Suivant l’aspiration légitime de millions de Vietnamiens vivant au Vietnam ainsi que de réfugiés vietnamiens anticommunistes établis à travers le monde, nous demandons respectueusement au Tribunal judiciaire de bien vouloir procéder au réexamen du maintien de la statue de Hồ Chí Minh dans l’espace public à Montreuil et, le cas échéant, de rendre une décision ou un jugement ordonnant le retrait officiel de cette statue, au regard des principes de dignité humaine, de mémoire historique, du respect des victimes des régimes totalitaires ainsi que des valeurs démocratiques et républicaines de la République française.
2. Demander l’ouverture éventuelle d’études, d’auditions, de consultations publiques ou d’évaluations historiques et juridiques indépendantes concernant les faits et événements mentionnés ci-dessus.
3. Demander au Tribunal judiciaire et aux autorités compétentes de porter attention aux droits des victimes, des réfugiés politiques vietnamiens et des communautés ayant subi les conséquences des politiques communistes au Vietnam.
CONCLUSION
Nous demandons respectueusement au Tribunal judiciaire d’examiner cette requête dans un esprit de respect de l’État de droit, de protection des droits humains, de préservation de la justice historique et de respect des valeurs démocratiques de la République française.
Nous sollicitons notamment :
1. Le réexamen administratif et juridique du maintien de cette statue dans l’espace public ;
2. L’ouverture éventuelle d’une consultation publique associant :
– les associations vietnamiennes concernées ;
– des historiens ;
– des organisations de défense des droits humains ;
– les représentants des collectivités locales ;3. Une évaluation indépendante prenant en considération :
– les principes de dignité humaine ;
– le respect de la mémoire des victimes ;
– les valeurs démocratiques et républicaines de la République française ;4. La prise en considération du fait que la France, État démocratique attaché aux droits humains, à la liberté religieuse et aux valeurs universelles, ne saurait rester indifférente aux préoccupations exprimées par une partie importante de la communauté vietnamienne réfugiée concernant l’hommage public rendu à Hồ Chí Minh dans un espace public français.
La présente démarche ne vise ni à provoquer la haine, ni à porter atteinte aux relations diplomatiques entre États, mais uniquement à faire entendre la voix des réfugiés politiques vietnamiens et des personnes estimant avoir souffert des conséquences des politiques communistes au Vietnam, dans le respect du droit français, européen et des principes démocratiques.

We further respectfully ask that consideration be given to the fact that France — as a democratic nation governed by the rule of law and committed to human rights, freedom of religion, and universal values — cannot remain indifferent to the profound concerns expressed by a large portion of the Vietnamese refugee community in France and throughout the world regarding the public honoring of Ho Chi Minh in a French public space.

.......................................................................................Following the peaceful demonstrations organized by members of the Vietnamese anti-communist refugee community at the Montreuil park where the statue of Hồ Chí Minh is installed, the local authorities proceeded to partially cover and restrict the public display of this statue pending a legal and administrative review concerning a request for its removal.
These demonstrations were conducted in a strictly peaceful spirit, in full respect of public order and the laws of the French Republic, in order to express opposition to the public honoring of a historical figure whom many victims, families of victims, political refugees, and members of the Vietnamese diaspora consider to be associated with policies and events that resulted in serious violations of human rights, fundamental freedoms, and human dignity in Vietnam during the twentieth century.
Through this petition, we respectfully request that the Judicial Court of Montreuil reconsider the maintenance of this statue in public space, in light of the principles of human dignity, historical memory, respect for victims, and the democratic and republican values of France.
I. PURPOSE OF THE REQUESTS AND ALLEGATIONS
1. Concerning political and ideological responsibility
According to our view, and that of a significant part of the Vietnamese refugee community throughout the world, Hồ Chí Minh was the founder and principal leader of the Vietnamese communist system, with the support of the international communist movement of that period.
This one-party political system led, for several decades, to significant restrictions on civil liberties, religious freedom, freedom of expression, and fundamental rights in Vietnam.
2. Concerning historical events allegedly constituting serious human rights violations
We respectfully ask the Judicial Court to pay attention to the following historical events:
• The Xô Viết Nghệ Tĩnh movement;
• Land Reform;
• The Nhân Văn – Giai Phẩm affair;
• The campaigns known as “Revisionism against the Party”;
• The 1968 Tết Mậu Thân Offensive;
• The re-education camp system after 1975;
• Controversies relating to territorial sovereignty and relations with China.According to numerous testimonies, historical documents, survivor accounts, and members of the overseas Vietnamese community, these events allegedly caused considerable human losses, serious violations of human dignity, confiscation of property, and major violations of fundamental freedoms.
3. Concerning the Xô Viết Nghệ Tĩnh period (1930–1931)
We consider that this period marked the introduction into Vietnam of a revolutionary model based on class struggle, accompanied by violent rhetoric targeting certain social groups, particularly intellectuals, landowners, and other groups regarded as ideological opponents.
According to our analysis, this political and ideological orientation contributed to creating conditions that later facilitated serious human rights violations.
4. Concerning Land Reform (1949–1956)
We solemnly affirm that the Land Reform campaign conducted in North Vietnam led, according to numerous historical testimonies, to arbitrary convictions, public denunciations, confiscation of property, detention, and executions of civilians.
Many documents and testimonies state that this campaign profoundly affected family structures, social balance, cultural life, and the human dignity of many Vietnamese families.
5. Concerning acts allegedly constituting serious human rights violations
We consider that several political policies and campaigns of this period display characteristics that may be analyzed as systematic repression against civilians, including:
• Prolonged detention without fair trial;
• Public denunciations;
• Extrajudicial executions;
• Repression targeting intellectuals, artists, and religious leaders;
• Restrictions on freedom of expression, conscience, and religion.We respectfully request that these facts be studied and evaluated in light of the principles of international human rights law and international standards relating to the protection of civilian populations.
6. Concerning the destruction of traditional and moral values of society
We solemnly affirm that certain political campaigns conducted during this period caused profound divisions within Vietnamese families and society, weakening the traditional cultural, spiritual, humanistic, and moral values of the Vietnamese people.
7. Concerning the consequences for religious and cultural life
Many religious, cultural, and spiritual establishments were allegedly confiscated, closed, or subjected to operational restrictions during periods of political reform and control, thereby harming religious freedom and the spiritual life of part of the Vietnamese population.
8. Concerning historical relations with France during the Indochina period
We respectfully request that the Judicial Court objectively study and assess the events that occurred during the conflicts in Indochina, including acts of violence, detention conditions, and treatment inflicted upon certain French, Vietnamese, and allied prisoners of war during this complex historical period.
II. LEGAL BASIS AND INTERNATIONAL PRINCIPLES
We respectfully request that the Judicial Court examine this petition on the basis of:
• The Charter of the United Nations;
• The 1948 Universal Declaration of Human Rights;
• The International Covenant on Civil and Political Rights;
• The Convention against Torture;
• Principles of international humanitarian law;
• Principles of human dignity and protection of fundamental freedoms;
• European principles relating to respect for the memory of victims of totalitarian regimes.III. REQUESTS
1. Following the legitimate aspirations of millions of Vietnamese people living in Vietnam, as well as Vietnamese anti-communist refugees settled throughout the world, we respectfully request that the Judicial Court proceed with a reconsideration of the maintenance of the Hồ Chí Minh statue in public space in Montreuil and, where appropriate, issue a decision or judgment ordering the official removal of this statue, in light of the principles of human dignity, historical memory, respect for victims of totalitarian regimes, and the democratic and republican values of the French Republic.
2. Request the possible opening of studies, hearings, public consultations, or independent historical and legal evaluations concerning the facts and events mentioned above.
3. Request that the Judicial Court and the competent authorities pay attention to the rights of victims, Vietnamese political refugees, and communities that have suffered the consequences of communist policies in Vietnam.
CONCLUSION
We respectfully request that the Judicial Court examine this petition in a spirit of respect for the rule of law, protection of human rights, preservation of historical justice, and respect for the democratic values of the French Republic.
We specifically request:
1. The administrative and legal reconsideration of the maintenance of this statue in public space;
2. The possible opening of a public consultation involving:
– concerned Vietnamese associations;
– historians;
– human rights organizations;
– representatives of local authorities;3. An independent evaluation taking into consideration:
– principles of human dignity;
– respect for the memory of victims;
– the democratic and republican values of the French Republic;4. Consideration of the fact that France, as a democratic State committed to human rights, religious freedom, and universal values, should not remain indifferent to the concerns expressed by a significant part of the Vietnamese refugee community regarding the public honoring of Hồ Chí Minh in a French public space.
This petition is intended neither to incite hatred nor to undermine diplomatic relations between States, but solely to make heard the voices of Vietnamese political refugees and persons who believe they have suffered from the consequences of communist policies in Vietnam, in full respect of French law, European law, and democratic principles.

.......................................................................................Etter de fredelige demonstrasjonene organisert av medlemmer av det vietnamesiske antikommunistiske flyktningsamfunnet i parken i Montreuil, hvor Hồ Chí Minh-statuen er oppført, har de lokale myndighetene delvis dekket til og begrenset eksponeringen av denne statuen i påvente av en juridisk og administrativ vurdering knyttet til et krav om fjerning.
Disse demonstrasjonene fant sted i en strengt fredelig ånd, med respekt for offentlig orden og lovene i Den franske republikk, for å uttrykke motstand mot den offentlige hyllesten til en historisk person som mange ofre, familier til ofre, politiske flyktninger og medlemmer av den vietnamesiske diasporaen anser for å være knyttet til politikk og hendelser som førte til alvorlige krenkelser av menneskerettigheter, grunnleggende friheter og menneskelig verdighet i Vietnam i det 20. århundre.
Gjennom denne anmodningen ber vi respektfullt Domstolen i Montreuil om å revurdere opprettholdelsen av denne statuen i det offentlige rom, i lys av prinsippene om menneskelig verdighet, historisk minne, respekt for ofrene og de demokratiske og republikanske verdiene i Frankrike.
I. FORMÅLET MED KRAVENE OG PÅSTANDENE
1. Om politisk og ideologisk ansvar
Etter vårt syn, og etter synet til en betydelig del av det vietnamesiske flyktningsamfunnet verden over, var Hồ Chí Minh grunnleggeren og hovedlederen for det vietnamesiske kommunistiske systemet, med støtte fra den internasjonale kommunistbevegelsen på den tiden.
Dette ettpartisystemet førte i flere tiår til betydelige begrensninger av sivile friheter, religionsfrihet, ytringsfrihet og grunnleggende rettigheter i Vietnam.
2. Om historiske hendelser som angivelig utgjør alvorlige menneskerettighetsbrudd
Vi ber respektfullt Domstolen om å rette oppmerksomhet mot følgende historiske hendelser:
• Xô Viết Nghệ Tĩnh-bevegelsen;
• Jordreformen;
• Nhân Văn – Giai Phẩm-saken;
• Kampanjene kjent som «Revisjonisme mot Partiet»;
• Tết Mậu Thân-offensiven i 1968;
• Systemet med omskoleringsleirer etter 1975;
• Kontroverser knyttet til territorial suverenitet og forholdet til Kina.Ifølge mange vitnesbyrd, historiske dokumenter, overlevendes beretninger og medlemmer av det vietnamesiske samfunnet i utlandet, førte disse hendelsene til betydelige tap av menneskeliv, alvorlige krenkelser av menneskelig verdighet, konfiskering av eiendom og alvorlige brudd på grunnleggende friheter.
3. Om perioden Xô Viết Nghệ Tĩnh (1930–1931)
Vi mener at denne perioden markerte innføringen i Vietnam av en revolusjonær modell basert på klassekamp, ledsaget av voldelig retorikk rettet mot bestemte samfunnsgrupper, særlig intellektuelle, jordeiere og andre grupper som ble betraktet som ideologiske motstandere.
Etter vår analyse bidro denne politiske og ideologiske orienteringen til å skape forhold som senere muliggjorde alvorlige menneskerettighetsbrudd.
4. Om Jordreformen (1949–1956)
Vi erklærer på ære og samvittighet at jordreformkampanjen i Nord-Vietnam, ifølge mange historiske vitnesbyrd, førte til vilkårlige domfellelser, offentlige fordømmelser, konfiskering av eiendom, fengsling og henrettelser av sivile.
Mange dokumenter og vitnesbyrd hevder at denne kampanjen dypt påvirket familiestrukturen, den sosiale balansen, kulturlivet og den menneskelige verdigheten til mange vietnamesiske familier.
5. Om handlinger som angivelig utgjør alvorlige menneskerettighetsbrudd
Vi mener at flere politiske tiltak og kampanjer i denne perioden hadde kjennetegn som kan analyseres som systematisk undertrykkelse av sivile, herunder:
• Langvarig fengsling uten rettferdig rettergang;
• Offentlige fordømmelser;
• Utenomrettslige henrettelser;
• Undertrykkelse av intellektuelle, kunstnere og religiøse ledere;
• Begrensninger av ytringsfrihet, samvittighetsfrihet og religionsfrihet.Vi ber respektfullt om at disse forholdene blir undersøkt og vurdert i lys av prinsippene i internasjonal menneskerettighetslov og internasjonale standarder for beskyttelse av sivile befolkninger.
6. Om ødeleggelsen av samfunnets tradisjonelle og moralske verdier
Vi erklærer på ære og samvittighet at visse politiske kampanjer i denne perioden forårsaket dype splittelser innen vietnamesiske familier og samfunnet generelt, og svekket de tradisjonelle kulturelle, åndelige, humanistiske og moralske verdiene til det vietnamesiske folk.
7. Om konsekvensene for religiøst og kulturelt liv
Mange religiøse, kulturelle og åndelige institusjoner ble angivelig konfiskert, stengt eller underlagt restriksjoner i perioder med politisk reform og kontroll, noe som skadet religionsfriheten og det åndelige livet til en del av den vietnamesiske befolkningen.
8. Om de historiske forbindelsene med Frankrike under Indokina-perioden
Vi ber respektfullt Domstolen om objektivt å undersøke og vurdere hendelsene som fant sted under konfliktene i Indokina, inkludert voldshandlinger, fengslingsforhold og behandling av enkelte franske, vietnamesiske og allierte krigsfanger i denne komplekse historiske perioden.
II. RETTSLIG GRUNNLAG OG INTERNASJONALE PRINSIPPER
Vi ber respektfullt Domstolen om å behandle denne anmodningen på grunnlag av:
• De forente nasjoners pakt;
• Verdenserklæringen om menneskerettighetene av 1948;
• Den internasjonale konvensjonen om sivile og politiske rettigheter;
• Konvensjonen mot tortur;
• Prinsippene i internasjonal humanitær rett;
• Prinsipper om menneskelig verdighet og beskyttelse av grunnleggende friheter;
• Europeiske prinsipper knyttet til respekt for minnet om ofrene for totalitære regimer.III. KRAV
1. I samsvar med de legitime ønskene til millioner av vietnamesere som bor i Vietnam, samt vietnamesiske antikommunistiske flyktninger bosatt over hele verden, ber vi respektfullt Domstolen om å foreta en ny vurdering av opprettholdelsen av Hồ Chí Minh-statuen i det offentlige rom i Montreuil og, dersom det anses passende, avsi en beslutning eller dom som pålegger den offisielle fjerningen av denne statuen, i lys av prinsippene om menneskelig verdighet, historisk minne, respekt for ofrene for totalitære regimer og de demokratiske og republikanske verdiene til Den franske republikk.
2. Å åpne for eventuelle studier, høringer, offentlige konsultasjoner eller uavhengige historiske og juridiske vurderinger av de ovennevnte hendelsene og forholdene.
3. Å anmode Domstolen og de kompetente myndighetene om å ta hensyn til rettighetene til ofrene, vietnamesiske politiske flyktninger og samfunn som har lidd under konsekvensene av kommunistisk politikk i Vietnam.
KONKLUSJON
Vi ber respektfullt Domstolen om å behandle denne anmodningen i en ånd av respekt for rettsstaten, beskyttelse av menneskerettigheter, bevaring av historisk rettferdighet og respekt for de demokratiske verdiene i Den franske republikk.
Vi ber særlig om:
1. En administrativ og juridisk ny vurdering av opprettholdelsen av denne statuen i det offentlige rom;
2. Opprettelse av en mulig offentlig konsultasjon med deltagelse av:
– relevante vietnamesiske foreninger;
– historikere;
– menneskerettighetsorganisasjoner;

– prinsippene om menneskelig verdighet;

– de demokratiske og republikanske verdiene i Den franske republikk;4. Å ta i betraktning at Frankrike, som en demokratisk stat knyttet til menneskerettigheter, religionsfrihet og universelle verdier, ikke bør forholde seg likegyldig til bekymringene uttrykt av en betydelig del av det vietnamesiske flyktningsamfunnet vedrørende den offentlige hyllesten av Hồ Chí Minh i et fransk offentlig rom.
Denne henvendelsen har verken som mål å oppfordre til hat eller å skade diplomatiske forbindelser mellom stater, men utelukkende å la stemmene til vietnamesiske politiske flyktninger og personer som mener de har lidd under konsekvensene av kommunistisk politikk i Vietnam bli hørt, i respekt for fransk og europeisk lovgivning og demokratiske prinsipper.
