Dear Sir,
We are writing you in order to encourage the prompt passage of PL 41-2010, a promise of the government since 2006, and a legislative project since early 2009. We represent a group of young people from an open-data community called Transparency Hackday. We stand alongside other allies, including the OAB, ABRAJI and other media organizations, academics and the NGO sector, in order to support the unamended passage of a law that is critical to our government’s domestic and international legitimacy and stability.
More than 85 countries possess the right to access information in the public trust, and Brazil’s resistance is unacceptable for a country that holds itself as an emerging world leader. The right to access government information is a fundamental human right, to which Brazil has committed itself in international and domestic law; it is a repeated motif in the 1988 constitution (articles 5 and 37), and in treaties and covenants to which Brazil is a signatory, inluding the Organization of American States Covenant and the United Nations Declaration of Human Rights, among others.
A government that resists transparency and access to public information is fundamentally in conflict with the guiding principles of a Republican Democracy. Government by the people requires access to the very information its representatives produce to serve the public good.
Brazil must set an example in the coming years; it will host two global sporting events over the next decade, is currently undertaking massive infrastructure projects, and has recently found oil, a resource often considered a “curse” because of the corruption it tends to produce.
Access to information makes for better informed citizens and therefore a greater capacity to participate in the democratic process. It also diminishes damaging economic asymmetries, strengthens the media, improves the ability of businesses to comply with law and enhances efficiency and professionalism in government.
We support the immediate, unamended passage of the law PL 41-2010 and respectfully request a response to our request for support. We look forward to hearing from you.
