Dear Sir,

 

No action has been taken by PTA and our new DSL connections are still being denied by PTCL.

 

It seems that PTA has became a sub-ordinate department of PTCL as its inaction is supporting an aggressor who continues to usurp the rights of other operators who’re dependent on its infrastructure.  

 

We see no reason continue paying huge license fees and annual renewals to PTA when it has failed to protect the rights of its licensees.

 

After becoming hopeless with inability of PTA, we’re taking the matter to other forums.

Dear Sir,

 

The matter is very serious for the DSL operators and we request immediate orders from PTA to PTCL to restore the services, order an inquiry and fine PTCL which should be passed on to DSL operators as compensation.

 

Private DSL operators have been bleeding already due to anti-competitive practices of PTCL and PTA has not been able to control the atrocities of incumbent.

Dear Dr. Yaseen Sahib,
 
The matter is of grave concern to the DSL operators as none of the new DSL connections are being processed by PTCL. We’ve been told by the insiders that PTCL is delaying the connections in garb of this new automated systems but actually, they’re short of their yearly targets of new DSL connections and are using coercive measures to force customers to opt for PTCL’s DSL connections.
 
As a matter of fact, if PTCL is switching to new system, they should switch it when it’s full operational and continue manual processing meanwhile.
 
We’d therefore request PTA to kindly direct PTCL to immediately process our papers for new DSL connections and also compensate DSL operators for delaying these connection for last five days.

There has been no action forthcoming from PTCL on this as papers of DSL operators are not being signed by PTCL officials in Karachi and Lahore.

Dear Zaman Sb,
 
For the last two days the DSL operators have been unable to get a single DSL LQT form signed by PTCL CCCs in Lahore and Karachi regions and operators have been told that instructions have been passed by PTCL H/Q to stop the manual process and go on some online system for the same. While we appreciate PTCL trying to put in place a more automated system one would expect that PTCL’s DSL partners would be forewarned about the likely introduction of any such online system. Stopping the existing arrangements saying that on-line system is being introduced, amounts to stopping DSL Operators normal business. I would suggest the following to resolve this:
 
a.       Necessary instructions be passed to your concerned GM’s in the regions on URGENT basis to sign LQT Forms already submitted by your DSL partners to them since yesterday as this is really hurting their business.
b.      We would welcome an automated system but before bringing such a system online new SOP’s must be made and shared with all stake holders so everyone knows what will be the process to get a customer online, how much time it will take etc.  The existing SOP was made with lot of effort between PTCL and ISPAK under PTA’s supervision.  We expect that in the same spirit the new SOP’s should be agreed between the stakeholders before going for its implementation.
c.       Once the SOP’s are agreed for a certain period, both the existing and new proposed systems would be run in parallel so that all concerned are trained and operational issues, if any, encountered in the new system are overcome.

I believe instead of ridiculing the regulator the following course should be adopted as PTA can not exert its authority in isolation
 
File a petition with PTA and if it fails to decide on violation of the interconnect agreement within 90 days then take the matter to court.
 
In case PTA decides in an ambiguous manner then challenge the decision in the high court...it may take a few months to decide but once such decisions start coming in the regulator as well as the dominant operators would start realizing that justice will be done.
 
PTA has very recently punished PTCL by reducing APC which has caused much more financial harm to ptcl than the few thousands ptcl plans to save through arm twisitng of already receding dsl operators..
 
No institution can deliver in isolation and PTA has traditionally avoided to settle matters through court as it has tried to achieve a compromise solution to get the things moving instead of keeping them lingering in the courts..
 
It's about time that free judiciary starts playing its role in delivering justice and setting precedents that help the regulators to act independently knowing that the justice system is not going to halt progress ....that's how things are done in the countries where judiciary is independent
 
even if chimpanzees are occupying positions in PTA other institutions can not be ignored for the rot they contribute to

After reading the contents of the email, it said that the issue will
be taken up to different forums.

Why different forums? ISPs can easily take the matter to the court not
only against the regulator (for not providing a level-playing field)
but because the PTCL has performed a breach on the contract, and ipso
facto, anyone can challenge the ineptness of the company. Besides,
they don't need to take this case alone; they can take up various
other cases as well from the past.
