Urgent-Please Read Immediately
Dear Client:
We are writing to inform you of two new radical and extreme proposals to take away your rights. We urgently need your help to contact your N. C. legislators in the next 10 days to oppose this legislation. The workers; compensation and tort reform bills being voted on are both “radical proposals that for many will virtually take away your constitutional right to receive any meaningful recovery in the future in the workers’ compensation system and the courtrooms” for future injuries (such as car accidents) and diseases (including cancer) that might afflict you and/or you family and friends. The changes that are being proposed are as follows:
1. Workers Compensation Benefits Eliminated (Workers Comp Bill)
Insurance company lobbyists are pressuring the state legislators to cut workers’ compensation benefits significantly. The changes include:
• If you are injured, and permanently disabled, the law would automatically cut off your benefits after only 500 weeks. One effect of this would be to push injured workers onto government programs such as Social Security disability Medicare, and Medicaid. In other words, the insurance companies are passing the costs onto you and your fellow taxpayers.
• The insurance companies would control your total medical care; you will have no choice of a doctor regardless of your condition. Even if you are diagnosed with a disease or disability by your own family or other chosen doctor, your doctor’s opinion does not count.
• If you can return to do even low paying work much different from you old job, you will lose your benefits. If you are injured and can’t do your job, the company can make you take practically any job at minimum wage without benefits.
2. Products Liability, Motor Vehicle Accidents (Tort Reform Bill, Senate Bill 33).
The proposed changes would close the courthouse doors for many individuals hurt by asbestos, prescription drugs and other defective products, and in car accidents. It is most important that you share this letter with your friends and family and tghat you immediately contact you legislators about this terrible bill.
• The product liability bill may take away all of your rights to sue asbestos companies or others should you develop asbestos diseases including cancer in the future. Likewise, if you are given a bad drug or injured by a defective medical device, whatever your injury, the new law appears to say that if the government ever regulated or attempted to regulate the industry, there is no recovery.
• For significant car wreck and other injury cases, the proposed new would severely limit the damages you can recover. Further you would have to try your case twice.
• If you are seriously hurt in an accident, you will have to disclose information about your insurance but the company does not have to do the same. And if you win, under the new law they could tax 75% of your punitive damages verdict.
What can you do?
First: IMMEDIATELY write and call your legislators. Their names and phone numbers are below. Tell them you oppose both of these bills and that they should not vote for them.

A special group gathering of families from all over the State is being planned. Third: spread the word and tell your family and friends. It is most important that your legislators hear from all of the voters in your county that you do not agree with these bill. Tell them that their constitutional rights are at stake. We must spread the word that if these dangerous new laws are passed, they will severely harm the ability of working families across our State to get access to justice.
