DEMAND NOTE AND SERVICE TAX
While demand note would act as an interim measure, we need to find out the legal implication. How?
1) Any impact till now on TCN.
2) Method adopted by other AOAs
3) My knowledge says that S.Tax has to be paid by AOA where the Maint.Charges per month are Rs 5,000/- and above.
4) Seek advice from practicing CAs dealing with Service Tax. To reaffirm my knowledge , I will send an email to CA Gupta who regularly sends articles on Service Tax to the CA fraternity.

3.       Square Footage area data done to ~99% accuracy and sent

I agree with Dhir uncle. Service Tax dept can be very adamant and will only go as per their interpretation. In the face of all logic they will adhere only to their own understanding of the law - I personally face this challenge at work ever so often.

Since, what we propose to do is unconventional and will be open to interpretations, we need to take adequate safeguards by taking formal tax opinion in detail from a credible/competent source. Cost of service tax non-compliance can be huge and with the recent changes can lead to imprisonment as well.
