We don’t go to police at once, fearing that the police might rob us. Trust me, 1000 Rupees to a police is good than spending a day in court with Criminals. The courts doesn’t look like the one we see in the films. It stinks as bad as a public toilet. And most importantly the stress and the mental torture that I have gone through in the period of six months are all worth more than 1000 Rs L My browser will know how much laws in Indian penal code I would have checked in this 6 months to see if I and my career are safe enough. Happy that I have passed through this phase of my life.

Hi BB,

                21.11.2013 was not another normal day in my life. I was travelling in my bike towards Infosys shols DC around 9 a.m. It was all going smooth when suddenly a girl aged 19 jumped before my bike out of no-where. She was a student in new prince Venkateshwara College (which I came to know later) and she had tried to cross the road between the gap in the center median which was allocated for Lamp post. It was clearly a no crossing zone. There was a bike going to my immediate left and a MTC bus was travelling to the immediate left of that bike. I had no visibility of anything towards my left other than the bus and the bike. Suddenly the girl ran across the bus, missing the bike to my left only to get hit by me. I just had a fraction of a second to apply a brake and I failed in the attempt. I didn’t drive rashly. I had enough control over the vehicle that I didn’t fall over or get even a scratch in my body, I was still sitting in my bike. Morning 9 in medavakkam road going with a speed of 40-50 km/hr itself is a huge huge task.

 

                Since I could see her clearly struggling in the middle of the road, I parked the bike in the bus stop, took her to the nearest ortho clinic in a share auto with the help of 2 other people from the accident spot. The girl was treated, parents were called over. The 2 other people explained that there wasn’t any mistake from my side. Parents were equally acknowledging the fact that her daughter doesn’t know to cross and this is the first she is crossing on her own. The receptionist in the hospital was asking to book a FIR since it was an accident and the girl’s father clearly said that he is not interested in filing FIR with a statement ‘Police will eat money from my pocket too, I would rather spend it to my child’s medicinal expenses’. I was there in the hospital till 1 after which I came directly to office and started working. The 2 person who came with me in share auto also started moving.

 

22.11.2013 I got a call from the girl’s father asking for my vehicle number. I was asking for the reason and he said he needs it to file FIR. He said that he works in ‘Bajaj Insurance’ company and he promised that I won’t bring me any harm.  I was angry on him and I could sense that he is clearly trying to do something evil. I said that I cannot give the number and I just cut the call. That night by 10 P.M I got a call from the Tambaram police station asking to meet them the next day. I went there with my Dad and was shocked to see that the FIR was registered with false details. The case was termed as ‘Hit and Run’ which obviously didn’t happen. The content of the case was also framed as the petitioner was crossing the road properly but purely because of my negligence and rash driving the accident took place. The petitioner also mentioned that she was admitted in Vijaya hospital but whereas the truth was that she was admitted by me in Dr.Kumar’s Ortho clinic in sembakkam. There will also be a pictorial representation (Drawing) of the accident spot attached in the FIR and it was showing that it happened in the signal crossing.  I was fuming there saying that I won’t sign the acceptance form of the FIR. But the police was trying to console me that he knows the truth but since the girl had 2 fractures in Hip there would be lot of expenses and this won’t affect my career and the claims will be paid by the insurance people. After long conversation I signed it and went to court in Chrompet, paid the penalty of 2500Rs.

 

20.03.2014 I received a notice in my door which was addressed to ICICI Lombard Insurance and with my name as Respondent 2 asking to appear in court in person on 4th June 2014 (tomorrow). The claims that were made by the petitioner was atrocious!

 

Transport to hospital – 15,000
Hospital expense – 3,00,000

Medicines -1,00,000

Nourishment – 50,000

Damages to cloth and articles – 1,00,000 (not sure whether she wore a gold salwar)

Others (Family transport expense) – 1,00,000

Compensation for pain and suffering – 5,00,000

Compensation of family suffering – 5,00,000

Compensation for the loss of earning power 5,00,000

 

In total 21,65,000 Rs was claimed to ICICI! Even though I will not pay a single Rupee to them, I still feel it’s a very bad human behavior to exploit someone like this.

 

Why did all this happen? Yes! It was because of my negligence. I never knew what should be done if I bump into someone unintentionally. I should have at once filed an FIR so that I would have had some evidences in the area to prove that it wasn’t my mistake. The father of the affected was careful enough to send me and the other 2 people who accompanied me from the hospital and then registered an FIR. Worst part is I didn’t collect the evidence numbers.

So what to do when you meet with a vehicle accident?

1.      Take the bike/car straight to the nearest police station.

2.      Explain the incident, file an FIR.

3.      Let the police come and investigate.

4.      Do take some photos or get sign from people who are supporting you in the accident area.

5.      Do not feel pity for the affected.

6.      Do have your bike insured all the time. Renew the insurance well before the expiry date.
