Nuku'alofa, 8 April 2009: The Kele’a newspaper is continuing its campaign to mislead the public in spite of having made a legal commitment to apologise for the defamatory articles it has published about the Hon Prime Minister.

The Kele’a newspaper had agreed in writing filed with the Supreme Court to publish six different articles of apology to the Hon Prime Minister on the front page of their newspaper in six consecutive weeks in order to have the six outstanding defamation cases against them withdrawn.

The agreement was signed by Siosiua Po’oi Pohiva, owner and publisher of Kele’a, Laucala Pohiva, Deputy Editor of Kele’a, and Falisi Tupou, Manager and News Reporter of Kele’a, and was filed in the Supreme Court in the March 2009.

The six defamation suits against the Kele’a newspaper arose out of series of different defamatory articles published by the Kele’a newspaper in 2007 which exposed the Hon Prime Minister to public hatred, contempt and ridicule.

The agreement that was signed by the proprietors and staff of Kele’a specified that upon being satisfied that that the apology published each week by the Kele’a complied with the specifications agreed to, the Hon Prime Minister’s legal counsel would then file an application in the Supreme Court to withdraw the related defamation suit.

The first apology was published on the front page of the 25th March edition of the Kele’a in both Tongan and English. However in the same edition, Siosiua Po’oi Pohiva went on to claim that the reason for their apology was a “technical shortcoming” on their part, in that they were unable to attend an “in chambers” session with the Supreme Court Judge and the Hon Prime Minister’s legal counsel.

Their ploy was to make the public think that if only they were able to attend the “in chambers” session with the Supreme Court Judge and the Hon Prime Minister’s legal counsel they would have been able win the defamation cases filed against them.

The truth is that they consistently and deliberately failed to comply with the directives of the Supreme Court. On five occasions they have failed to appear at directive hearings set by the Supreme Court. On three occasions they have failed to file their statements of defence within the time frame allowed by the Court. This amounts to the flagrant abuse of the country’s legal system and the flouting of the rule of law. But what defence could they have provided?
