My  name is Joe McCann and I am a homeowner in Tamarack.  I purchased a cottage in the first release and later a lot and built an estate home.  Through an unusual set of circumstances JP appointed me to the TMA board.  I resigned this spring after Credit Suisse became the declarant.  
For some of the newer owners in Tamarack I would like to share my experiences with the last years while the resort was in limbo.  The TMA board went from the direction of JP to the control of the homeowners.  Tim who was hired to run the TMA became the acting director, operator of the ski hill, golf course operator, fire chief, on site first responder, street maintenance supervisor and just about everything else.  
 
Under Tim's direction the board met monthly and all meetings were conducted in a very professional manner.  The board met and dealt with many problems, situations and personnel issues.  In the 7 plus years as a member of the board I never once observed any below board decisions or "bullying of homeowners".   In fact the board always took "the high road" and looked for any compromise to solve the problem. 
 
I feel that the next couple of years will be critical for the direction of Tamarack resort and that the board's input can influence the future. 
With this in mind and the upcoming elections for the board I would like to pass on my thoughts and observations.
 
Mike Carey has been on the board for some time and has a passion for Tamarack that is second to none.  He is out spoken at times and very eloquent.  He has spent countless hours in meetings and making connections with the politicians that control the fate of Tamarack.  I am friends with both Mike and Bev Hellman and think that she would bring to the table her expertise in  adding to the board.  At this time I feel the connections that Mike has nurtured will help us through this transition and wish that we could have both on the board.
 
Ron Merriman came to the board a few years ago and brought his accounting and financial expertise to the board.  The TMA has been blessed with an incredibly talented CFO Mike Druery.
The board needed Ron's input even though we had Bob Fullmer's years of business success and my experience Ron added a much needed input.   Ron speaks his mind ( ask anyone who attended the 2007 homeowner meeting) and is a needed balance for the board.  Ron is professional and has spent countless hours going over the accounting and forecasting of the budget.
 
I feel strongly that the homeowners are fortunate to have the current members on the board.

Hi Joe,

Much of what you mention below may be true.  I certainly could be incorrect, but I have heard otherwise.  Therefore, I don't wish to speak or vote from speculation.

So, I'll just ask my questions and await answers to be corrected.  Thank you for your patience and attention to this matter.

1) Is it true that you yourself, tried to sue the TMA over a lot dispute? Is this why you stepped down from the TMA Board?
2) Is it true that Mike Carey sold a property and had his transfer fees waived?  Yet when brought out publically, he did the correct thing by paying the fees?

I believe that many of us might not have all the information, good, bad, or ugly.  So please forgive me for asking blunt questions in a public forum.  As these very folks who we are to consider of votes publicly, should have a public vetting process; along with the vetting sources equally weighed.

As for disclosure, I am a home owner at Tamarack and operate the Zipline business.  I have in the past seen very good things by the TMA Board and some things that I have strong concerns over.  I too have been very vocal in the past, yet have laid low for the past three years.

So, shedding light on the situation, especially with lost revenues by the TMA ever since taking over operations, increasing recreation assessments, etc. asking the hard questions of our leadership seems the correct thing to do.

At the of the day with all the politics aside the fact remains that if it had not been for the TMA and it's positive legal relationship with Credit Suisse we all be the owners of homes and lots in a bear mountain.

You are absolutely correct. The TMA has a good relationship with CS.  I think any business that covers the costs to operate someone elses assests and protect the investment would win such favor.  However, and I clearly state I could be incorrect, but sometimes the ends justifies the means.  Outside of one meeting a year, the TMA operates very quietly and some have brought up issues of transparency.  I do think that we need to move beyond old points and focus on our futures.  I think it is healthy for the new faces of Tamarack to represent the New Tamarack of new. I think we need to have equal representation of all homeowners, lot owners, business owners.  I think we should all have equal opportunities to speak to our success and concerns.  I think all Board nominees should be treated equally and have equal opportunities to campaign. I think the resort, TMA, and others should continue to work with CS and ALL the other new managing partners, to operate the resort in a fashion that is fiscally responsible.

I believe these are all good points we can agree upon.

I would be happy to answer your question regarding our new home as I was the one who dealt with this issue.  No, we did not sell a home, we bought a home by auction.  And no, it is not true about the transfer fee in the manner that you stated.  I did not ask for the transfer fee to be waived.  And no, we did not agree to pay it once brought out publicly (I was unaware this was a public issue).  I am sorry if you have received incorrect information.  I do not participate in the google groups, so I was not aware people had questions.  

We purchased a home at the beginning of the year through auction.com that had the bank listed as the seller, so we assumed they were the owners.  There were several liens on the property, including utilities and TMA dues, and the transfer fee.  I asked the TMA who would be responsible for the transfer fee, us or the bank, as typically it is the seller who pays the transfer fee.  I was told that the transfer fees are typically not paid when properties are sold at auction, as all sales are final.  I received a document from the TMA stating this and it was included in our closing records. The TMA had no prior experience with properties sold through auction.com, and neither did I.  After our closing the TMA lawyer realized there had been a mistake, and that properties purchased at auction.com are not treated the same as traditional auctions.  I was then informed that a mistake had been made and that we did indeed need to pay the transfer fee, which we immediately agreed to do.  Michael and I have the greatest respect for all the TMA staff and we certainly did not want to put anyone in a bad position.  Our closing was final, and we had a letter stating that the transfer fee did not apply, so I'm guessing that we could have just refused to pay it.  I don't really know if we could, as this was never an option we considered.  

I hope this clarifies the situation for you. Again, I did not realize this was an issue.  Sometimes it's best to just ask a person directly involved rather that rely on hearsay. 

Also, based on your post, it looks like you may not be aware that Michael is not running again this year.  He has served on the board for 6 years, and feels like he has done his part in helping Tamarack stay viable all these years.

I am not sure where  you got the information regarding me stepping down from the board but there is no truth in this. .  I was appointed by JP who even though has been gone was still the declarant.  After the sale in April CS became the declarant and I volunteered to resign as I doubt that they would appoint me to one of their seats.    There never has been any threat to sue TMA by me 
For your information there is more than one meeting each year.  Town hall meetings are held throughout the year to allow owners to question the TMA regarding issues they may have.
