Dear All
I've applied for my Sports Club Membership to be refunded by
Tamarack Club. Several months ago, The Club Director [in good faith]
advised I would apply to the Controller, Mike Drury for this
reimbursement. I did so in early March in writing and by phone
message. The terms of the agreement say the money will be returned in
30 days. Now it's 60+ days and cash nor confirmation have been
forthcoming. It's a black hole.
My question to the Group is whether anyone has experience with
retrieving Club deposits? If not, does anyone know whether Mike Drury
is still with the organization and if not who would have taken his
responsibilities?
Finally, how would one communicate direct to the Receiver? Any
names and contact info much appreciated.

The terms of the club agreement as it was presented to me allow for the sale of three new memberships before the return on one deposit.

One of the issues surrounding Club deposits (I have one too) is that the money, to my understanding, was commingled with the LLC because the Club was owned by the LLC.  When you contact the Receiver, see if you can find out if this money was set aside (I severely doubt that).  If not, then we should probably get a list of all Club owners, hire an attorney, and petition the court to be part of the liability of the Resort in the Court proceedings.  Whereby, the TMA has counsel on its matters, the Club owners have no counsel.  I will see if I can find out more.  In the meantime, see what the Receiver says.

And, to answer your semi-rhetorical question, if it wasn't JP's
strategy before, I'm guessing it is now. I wonder whether there is a
more active role that the TMA or the homeowners individually should
be
playing to help strengthen a bid (by JP and/or others) that makes for
a quick transaction. The Shanahan/Dvorak plan from early March was
creative and interesting to the degree that CS still had any
financial
interest. It is now clear that they are done and, so as long as the
receivership is in place, the resort will be closed. Someone will be
able to buy the resort for pennies on the dollar and we need that to
happen sooner rather than later.

Bill is far more knowledgeable than I regarding this subject, but I
don't think anything can happen until JP either lets go of his
foreclosure battle or losses in court. Right now, I wonder if he even
would want to take it back over. I doubt he could get any investors,
even though he was a genius at that.

The only thing I see in it for him now is that if he took it back over,
everybody would have to be nice to him again.

I was under the understanding that the club membership list was going to be posted on the web before shutdown. I have not seen it.

I suspect too, that the deposits are no longer available.

We club members should develop a contact list of all club members quickly (Name Address, phone number, e-mail, full or sport, and amount of deposit). At some point in the near future the elephants will start to dance (or stampede) and we do not want to be lost in the dust. At a minimum, the existence of our claims for return of deposits should be made known to the court. They might be already, but of course, none of us club members have received any notice from the court.

Because our aggregate claim is significant, we might be able to appoint membership to the unsecured creditor's committee, if proceedings ever get that far.

The point is, develop a contact list now.

  Detailed message left toay b/c Mr. Wilson was in a meeting.  His voice mail promised to get back 'right away",so we'll see what that means.  For his $400+/hr salary one hopes it means with speed.
   A registered letter will probably be needed so that a court can see local efforts to communicate and resolve were exhausted in advance of any legal work. 
    Hopefully, he'll surprise me.
