I think that’s fair. The RSPB’s Malcolm Burgess is about to publish the results of a scientific study, which assessed Swifts across colony sites and shows a much lower ‘divorce’ rate of <10%, with fidelity to nest sites.
 
Will let the SLN know when this is published.

I have countered it by saying that this kind of intensive colony is artificial and not typical of what would be expected for a natural distribution of swifts during the breeding season. I have acknowledge that the behaviour will occur but not on the scale shown in the feature. Is this a reasonable response?

We don't but I just emailed Wild Justice with: the background and a few
points from the issues/failings that Mike has been working really hard, all
weekend, to extract and analyse from documents for us. Thanks Mike!
 
I had already been in contact with the Environmental Law Federation
regarding swift nest 1 at Banstead, but this case will supercede that in
size and also the liklihood of a successful prosecution. I will have to
submit a fresh enquiry I think, I will call tommorrow to check.
 
The Police have still not responded. I called am and pm yesterday. I am
tired of speaking to 101 which is a call centre that gatekeeps all access
to officers to zero.
 
I discovered that the first reports were made to Surrey Police 3 weeks ago.
Sorry, I can't recall if I had already shared that!

One particular thing I remember from the talk on wildlife crime at the SLN
conference last year: if you are unhappy with the response from police in
relation to an issue, contact the Police and Crime Commissioner for your
area.
 
PCC's oversee police forces and set policing priorities, and so it seems to
me that the level of response to wildlife crime is something to be raised
with them.

Destruction of Swift Colony in Surrey Sparks National Wildlife Crime

*Surrey, UK — 30 May 2026* — The demolition of a building in Surrey has
triggered serious concerns over a breach of UK wildlife law, after an
estimated 17–22 nests of the red-listed common swift (*Apus apus*) were
destroyed during works at Regent House near Dorking Station.
 
The demolition, carried out by Northeast Demolition UK for Hill Group as
part of a redevelopment by Clarion Housing, has impacted what may have been
the largest known swift colony in Dorking. The site had supported nesting
swifts for over a decade and had been monitored by local conservation
groups for many years.
 
Common swifts are a species of high conservation concern in the UK, having
declined by over 60% since the 1980s. They are legally protected under the
Wildlife and Countryside Act 1981, which makes it an offence to
intentionally or recklessly destroy active nests during the breeding season.
 
Residents report that warnings were raised with Surrey Police Wildlife
Officers in early May, shortly after swifts returned from migration and
were observed actively nesting within the building. Concerns were also
formally raised with Mole Valley District Council (MVDC) and Councillor
Margaret Cooksey, Chair of the Development Committee. Despite this,
demolition proceeded during peak nesting season.
 
Conservationists are now describing the incident as a significant wildlife
crime, raising broader concerns about the enforcement of environmental
protections during development across England.
 
Mole Valley District Council has confirmed it is now investigating the
situation. At the time of writing, no enforcement action has been announced
by Surrey Police Wildlife Officers.
 
Campaigners say the case highlights systemic gaps in the protection of
urban-nesting species and are calling for urgent national attention to
ensure wildlife laws are properly enforced during development projects.
 
Members of the public are encouraged to report any relevant information to
Surrey Police by calling 101 and quoting crime reference number
*45260062539*. Dorking residents with swift nest boxes or swift bricks are
being asked to play swift calls to help the displaced birds find new
nesting sites.

Thats a very interesting point Edward.
Would you please point us in the direction of the correct files, and share
your curated list of "nest defence" sounds?
This is a critical part of getting new sites established quickly. I have
been playing all sorts of stuff at stadium volume!. They are certainly
attracted. The first time I ever set it up, they were in my garden within
an hour of first trying. But if some of the sounds scare them off too, or
give out the wrong message, we should all be fixing this quickly as the
bangers are coming imminently.
We are told to keep playing the sounds, even after one box has been
discovered, so we don't want to be playing things that they read as
threatening. It might make them uneasy and put them off staying.
 
Is anyone else aware of this potential problem, or have the correct files
available for us all to use/upgrade?

Hello all.I am trying to make further contact with our HA with regard to our colony in Hemingford Grey in Cambridgeshire. To this point they appear to have been understanding, relaying their intentions to delay works to "improve" our rooflines until the breeding season is over. This is obviously welcome news. I do, however, fear potential works after our Swifts departure. Our Parish Council has generously allocated funding for nest boxes and also a visit from Edward Mayer to our village on July 7th. Now I fear my requests to representatives of our HA to attend Edwards presentation are falling on deaf ears.I'd really like them to continue with the pro-active intentions they displayed a few months ago but I fear the Wildlife Act protecting our Swifts becomes irrelevant once breeding season is over? Am I right in this belief?Any help appreciated!

Its probably like all the environmental crime got on at the moment with fly tipping, water crime, etc, they know that the government agencies aren’t taking action or if they do it takes ages for anything to happen that they can get away with it….

They already have networks and legal knowledge that might be really helpful
for crimes like the Banstead swifts one.

I'm using the default calls that came with my Peak Boxes caller..are you aware of these?  If so, are they suitable to draw in new nesting prospecting birds as we've lost our entire colony of 7 boxes with no returns for 4 years !  So very sad....

Hello Julie

Unfortunately the unit have no contact with the general public at all terms of reporting or initiating an investigation. We must apparently report it to our regional Police who promptly appear to ignore the reports on a wholesale level.

Their email system is even set up to only accept enquiries from the Police forces, essentially registered. There is no way to contact them as a member if the general public at all. Everything has been done to shut down options.

We are really 'stitched up' in every way.

Here are some other lines:

RSPCA:  will only investigate crimes where an animal is dead or sufffering...believe it or not Surrey Police were telling us to call the RSPCA yesterday, knowing full well they will not assist.

RSPCA suggested Natural England, but that is mis-directed.

Many of the general public think you can call the Police, RSPCA, RSPB and wildlife crime will be stopped immediately.

You can't blame them either as 1. it is association but 2. they are constantly told by governments that there are avenues of help, you must follow them...and yet the avenue is called Delay, Deny and Gaslight Avenue, not Justice Avenue. 

I think many human conditions in society are treated the same way now too. They say there is support and accountability, releatedly, but there is not.

Meanwhile, want to commit a wildlife crime? Housing developer/HA with government contacts? Feel free not to worry at all!
