Almost 15 days have passed and no feedback has come. In our last meeting which was called urgently, we had discussed and all the members were to conduct meetings with respective committee members and get back to us on how to go about on the matter. Q:Federation should go to high court :

Ø If yes, give two members name of your society who will attend the hearing / help in preparing to file appeal. The two persons should be ready to travel on the hearing dates on short notice. Pass a resolution stating that the society is supporting to file appeal in the High Court, and that the society is willing to pay the legal expenses which would be not less than Rs.50,000/- per society.

Ø If no, give a copy of the resolution passed by the society to that effect.

 

However, the decision taken by the majority of the societies will be binding on all the societies.

 

This needs to be done on the URGENT basis. We have already lost fifteen days, let us not take any more days. Please reply on or before 4th of June, 2014. No reply from the member, would be considered as if their society is not interested in filing the appeal.

Yes, finally we have received the order of ‘Deemed Conveyance’ from the DDR, Pune.

 

Shri Wableji has taken lot of trouble in persuading the matter along with me on all the fronts. Sanjay Dhadve, Bidkar & Shekhar Joshi have been there whenever we needed their help. And of course all of you including the individual building society representatives who have been standing like a wall of support and gave us strength. Without all this, it wouldn’t have been possible to achieve the success. My sincere thanks & hearty congratulations to each one of you.

 

Really speaking, I am not at all happy with the outcome of this ‘deemed conveyance’. After going thru the order in detail, it gives a strong feel that the order is issued with biased mind towards the federation. Having all the legal points on our side, the result was not completely in our favour. The only good thing about the order is that the land excluding the amenity space, space behind amenity, green zone and the bungalow plot has been given in the name of Federation.

 

We will have to urgently meet, study, discuss the order and then decide the next course of action.

 

I suggest we meet tonight at 9pm at the club house at B wing. The agenda is only one – ‘Deemed conveyance – the order and what next?’.

 

I will appreciate if all of you confirm the presence without giving any reason so that we do not lose time.
