You may recall that in 2008 Carburante decided to go ahead and pay bonus money for expanded street acreage in SWAPO2, even though the legal details of actual royalty distribution had not yet been determined. This issue has resurfaced recently, and we are asking for an interested property owner to provide a sample copy of their Deed of Trust ONLY WITHIN THE ROLLING ACRES or WILLOW BEND SUBDIVISIONS now claimed by former developers. Our purpose for this request is to analyze the deed regarding the exact nature of claims made by these developers to retain the street rights retroactively, an issue we explored last year. While we are not attorneys and do not make any claim to represent anyone in that fashion, we would like to see the exact wording of the deed and perhaps have it analyzed by a licensed attorney.

Please redact (cross out or white-out) any specific information about yourself or personal identity information, including name, SSN, phone number, etc. We do need the address to verify that it is indeed in the Rolling Acres or Willow Bend subdivisions, but we will not contact you at that address unless you wish us to. If you do not redact personal information on the document, we will do so before passing it along for legal analysis. It will not ever be distributed on the internet or any public venue by us (though your Deed of Trust is recorded and posted by Tarrant County). This will save us much time in having to research Deeds by hand ourselves at the county courthouse, where all deeds are readily available to the public.

What will we do with this information? Try to get the best accommodation we can for people regarding the claims by former developers of these subdivisions regarding these ancillary mineral rights.

We are only interested in the Deeds from Rolling Acres or Willow Bend I and II--do not send from other subdivisions.  As we have been told, your Deed includes reference to exact plat dimensions, so if you have the survey plat document, please pass that along as well. The most convenient method for us is to scan the document and email as an attachment to bo...@swapo2.com. We can handle large attachments in PDF, JPG, or TIF formats--do not worry about the size, just send the highest resolution up to 300 dpi grayscale from your scanner.

There is no need to be alarmed by this development, since it is not new and not necessarily negative. There is no imminent drilling planned by Carrizo in our area under the lease that know of, so this issue may not play out for quite some time. But we should be prepared to address this issue.

Interestingly enough, SWAPO2 appears to be yet again on the cutting edge with this issue, since there are no other mentions of it in published Barnett Shale stories that I can find. Street acreage rights we can win for our area may help our neighbors throughout Tarrant County and beyond.
