I am one of the witnesses to this incident.
Most of the apartment owners have two four wheelers. If each one uses the hose pipe to wash cars, it will be a huge consumption of potable water. This is why Mr. Moses, in the capacity of a duly elected President of the SAOA advised Mr. Jaison, to use water in a bucket rather than using the hose pipe to wash his car.
Mr. Jaison says, he is the owner of his apartment and he and the elected President have equal rights. He was also speaking about a previous litigation, which is contested in the Court of Law. The Court will decide the outcome in due course.
I strongly support our President Mr. Moses, who spoke on behalf of all SWAPNILITES.

I will fully subscribe to the claim made by Mr. Moses, as I was partly available during the said altercation at the spot though I could only join them only little after the said incident & not from the start. Besides being the SAOA secretary, as a flat owner, I certainly feel that, Mr. Jaison was entirely incorrect in the manner in which he handled his defence, more so the extravagant use of water for his personal use from the common facility, in no way becomes part of his ownership rights, at least not when the entire Swapnil fraternity is footing the bill, which is hitting below the belt of each resident/owner equally.
As for his infiltrated occupation of common area is concerned, is a matter still under judicial consideration & pending final execution from the Cochin corporation. Therefore his claim of holding any will full retraction letter from the complainant holds no ground & is legally untenable, since the Honourable High Court of Kerala has already passed a decree against his illegal occupancy of the said common area/s. Nevertheless we have also obtained needful legal opinion in the matter. Hence SAOA will continue to do everything in its power to ensure that justice prevails.
In my thoughtful suggestion, all Swapnilites, should rightfully respond, which not only will serve as a deterrent to those who feel they are above the law & civility but furthermore give SAOA the needful support, courage & the Iron will to continue our fight for Justice for all Swapnilites.

Point wise clarifications are given below with reference to his email.
1. On that morning , he was washing his car with hose pipe connected, that he didn’t mentioned in email. I politely asked him to refrain from that because we are paying KWA water at commercial rate and advised him to take a bucket of water to wash his car. How come washing car with hose pipe become his legitimate need?? Is it his privilege or basic need to wash his car with hose pipe??? He suddenly flared up and shouting at me saying, I have no right to tell like that . Everyone in this complex knows how he reacts to such situation, earlier incidents are many, he has shouted and used un parliamentary words at previous Presidents and Secretaries several time on different occasions, it is his style to shout at everyone without any reasons, he used to shout at our staffs, recently he shouted on Mr Ashokan, Guard. I worked 20 years with Indian Air Force and 14 years with United Nations as International staff . My behavior with other owners/residents in this complex is known to others. Children in this complex knows how rude he behaves , In 2015 he shouted and verbally abused at a group of Ladies for sitting on the bench kept on south-east corner and warned the ladies for sitting there . He also said the bench obstructs his driving path and if he hit small children by his car , then think its is an accident and he is helpless. He was betraying the ladies . Then the ladies complaint to SAOA and SAOA issued him with a warning letter. The letter and ladies complaint copy is attached for your ready reference.
2. Mr Jaison was mentioning about a case in that email. The case was given my Ms Molly Mathews, 2B for Illegal and unauthorized construction by him, SAOA was also party in that case. He lost the case and Court ordered Corporation of Kochi to take action with in six week. But due to his contacts in corporation, still now the illegal construction is not demolished . Now with the approval of AGM , SAOA given a case against Corporation of Kochi before the Hon’ble High Court of Kerala. Presently , he says that he got a letter from Ms Molly Mathews that she is withdrawing the case. I could not understand, how a case is withdrawn/settled after verdict . SAOA has given several complaints to Corporation of Kochi since 2010 regarding said encroachment and Corporation has issued several warning to him and asked him to remove the construction. All letters and correspondence are with SAOA Office and any one can check that. He also claims that the illegal construction was not made by him and the builder made for him. It’s a Himalayan lie from his part. You may see below the photograph to know status of flat when completed, there was no such illegal construction. The illegal construction destroys the aesthetic view of the Apartment complex as a whole and the Porch Slab is intended to cover the main Porch are not designed for load bearing.
3. Mr Jaison has personally targeted me by using below standard language and using words like PM , School master, Head Master, nasty President etc. in reply email which is not up to any civility .
4. Mr Jaison is using enormous amount of our precious water to maintain his garden which is in our common area. He should remove his garden from there immediately . Dampness and patches have already been developed beneath the roof slab clearly indicating that the occurrence of corrosion of the reinforcement steel have taken place which would ultimately result in to failure of the structure. Instances of muddy water overflowing on to the personnel using the Southern entrance of the building are reported and also during windy season , flower pot has fallen from roof top to ground floor.
5. SAOA is spending lot to time and money to follow up the illegal activity done by Mr Jaison, 1B , I request all owners to join hands and also complaint his rude behavior / threatening words to legal authorities . Your valuable suggestions /comments are most welcome.
