Finally Swabhimani Vasaikar Sanghtana (SVS) has got Vasai as well Wagholi-Mardes lathicharge enquiry report prepared by Spl.Inspector General of Police,KonkanRange. Initially SVS has filed application under Right to information act 2005 to state home ministry for Vasai lathicharge inquiry report for which Public information officer (PIO) of state home ministry has replied that same is not available with them & advised to approach Office of Spl.Inspector General of Police,KonkanRange. On 29.10.2010 SVS again made RTI application to PIO of Spl.Inspector General of Police,KonkanRange office with supporting letter received from PIO of state home ministry.
Later we have received reply from PIO of IGP Konkan Range office saying that the report is confidential & copy is sent to commissioner of police, Maharashtra state & hence report is not available with them. They have also forwarded our application to commissioner of police, Maharashtra state for further action. Subsequently SVS has also received reply from PIO of commissioner of police, Maharashtra state saying that the report is confidential & cannot be given under RTI act Clause 8(1) (e) & (j). Further PIO has mentioned that if we are not satisfied with this information then we should go in appeal as per RTI act.
Against this injustice SVS has gone in appeal in front of Deputy Inspector General of Police (Law & Order) & put our views. SVS has made good arguments supported by legal points given by Adv. Anil Dsouza in front of Appellate Authority & finally able to get most awaited report.
Conclusion of the Report: Spl.Inspector General of Police,KonkanRange has given clean cheat to police department with a remark that lathicharge was necessary to maintain law & order at that time.
Next Action: We are in touch with our MLA Vivekbhau Pandit for his guidance & also taking legal advice from our Adv. Anil Dsouza.
SVS Demand: All guilty policemen’s who has done inhuman lathi charge on innocent villagers MUST get punishment.
