we have to review on sale of parking slots to new flats by developer within the ambit of law ( Please review all attachments in detail)

my worry that, this should not be a liability to us by court as illegal or contempt of SC order at later stage of OC by any petition.

a careful examination and consultancy is required with clear affidavit by developer in consultation with legal advisor.

i suggest, we should also a set of standard agreement with new members prior to stamping, that society will not indemnify any of his sale agreement caluses/claims on such amenities except the possession and services thereon.

I pray to discuss this in MC meeting with clear agenda/quorum  with consensus.

A official intimation from MC to reader/members will be highly appreciated

Akhil Bhartiya Grahak Panchayat is an NGO who is working for consumers rights

Builder can not sale parking ---- Supreme Court Judgment. But builders extracts Rs 100000 to 500000 which is illegal
For Electricity meter only 7000 to 10000 are sufficient as per official website but Builder charges Rs 50000 to 150000
For Society formation only Rs 700 to 1000 sufficient but builder extracts Rs 25000 to 50000
Builder compulsory ask to take membership of club and charges Rs 100000 to 500000 is illegal activity
Society must be formed within 4 months from sale of 60% flats but builders avoid to form society
Until conveyance deed is not done you are not owner of your flat.
For amenity and infrastructure charges he can not charge separately
For delay possession, defects in flats, non provision of amenities, change in plans you can approach to consumer court/commission. For compensation upto 20 lakh approach District Forum, Compensation from 20 lakh to below 1 crore approach in State Commission, for above one crore approach to National Commission.

Always collectively file complaint against builder and file it in National Commission and avoid delayed justice.       

Ask refund of extra amount collected for electricity meter, illegal sale of parking, extra amount collected for society,
club membership charges, infrastructure charges etc.

If all of you have taken possession then please serve notice to him and ask refund of service tax also.
If your flat possession has not got, new booking then you have to pay service tax as there is no Govt circular for stopping of
collecting service tax.
