Subject: ABC’s Extreme Makeover: Home Edition requests nominations to
feature a military family in an upcoming episode.

1. Purpose: ABC’s Extreme Makeover: Home Edition is a show that
highlights families and individuals who have extremely emotional and
compelling stories by completely rebuilding and remodeling their
homes. Show producers are seeking a military family for an upcoming
episode and Soldiers across the country who meet the criteria are
encouraged to self-nominate. Following the request for nominations
in March, show producers received many entries and have extended the
deadline for nominations from military families through late June.

2. Facts:
a. Please see the enclosed flyer for all submission criteria and entry
instructions.

b. All nominations are due Monday, 23 June 2008.

c. For legal reasons, there are considerations that must be applied
due to gift and endorsement issues. Legal considerations are as
follows:
a. Army personnel must apply on their own initiative and be selected
by the show, not the Army.
b. If the person selected incurred an illness or injury while on
active duty on or after 9/11/01 as a direct result of armed conflict,
hazardous service, or in a combat operation or zone, he or she may
accept the gift, but the appropriate ethics counselor would have to
make a written determination.
c. If the person selected does not meet the above criteria, we would
need to view the transaction as outside employment, rather than
acceptance of a gift. In other words, the member is allowing his
image and house to be used as the basis for a television show, and the
compensation for doing that is the make-over.
d. The person may owe taxes on the make-over and may want to consult a
tax advisor or legal services (if such advice is provided).
e. The person will be acting in a personal capacity, so may not allow
the show to use his or her title, position, organization name or any
other Government authority to endorse the show, network, etc. This
does not include the use of the Soldiers rank. If selected by the
show, the member's ethics counselor should provide oversight and
counseling during this period, and should talk to the show's liaison
to explain Army rules.

d. ALL entries should be sent directly to the show contact listed in
the flyer. Any PA-related questions can be directed to Mr. Ken Hawes
from our OCPA-West office 310-235-7621. Please do not send nominations
to Mr. Hawes or anyone at the OCPA-West Office.
