I've just received a letter thanking me for my comments on the Wilmer Pl application and duplicating the previous letters about this saying I'd be notified if it went to committee etc. (see attached - let me know if it doesn't come through)

I haven't (obviously) submitted any comment on the new plans submitted, so is this a mistake?!

Or are they just assuming our previous comments and objections are carried forward for the new application?

that's weird I have just had a letter from Femi (head of Enforcement or planning)saying they have refused the first planning application..

The last application was rejected by the planning committee, but the developers have made a new application. It's not clear to me whether that means the process starts from the beginning (ie wide consultation and longer time for comments/objections etc) or what the opportunities for comments will be.

The developers can still also go to appeal.

So still not sure why I was sent the letter I was!

I suspect the amended/new planning proposal triggered someone that they forgot to inform the original complainants of the council decision.

Weather the formal rejection changes the process - new submission / amended - I don't know. - Nick??

The new application has no connection to the previous application administratively so a brand new 21 day period for consultation will begin once the new application is validated and site notices posted, etc.

Comments from previous applications are not generally considered with new, revised applications. 

However the previous conclusions of officers and committee are considered by the planners where they are relevant.

So in essence, we must write again about the merits or otherwise of the new scheme.

is there a limit on the amount of times they can apply...as it all costs so much in terms of planning/council time and takes up everyones time as well?

Surely application 2012/2228 is the old one, dating from August last year, that has been rejected.

Not really. You can't put the same application in twice but you can mut as many different application in as you like, but at £35k a time in application fees to LBH, and all the associated professional fees, it's expensive for the applicant.
