The NASCAR Cup Series playoffs kick off this Sunday at Darlington Raceway. But three days earlier, the real fight of the week took place in a Charlotte court room.
Representatives for NASCAR and the two teams suing it on antitrust grounds, 23XI Racing and Front Row Motorsports, returned to court Thursday for a hearing as the teams look to be granted a preliminary injunction to have their chartered status reinstated for
the rest of the 2025 season.
What ensued was two hours of debate on either side that turned messy as the hearing went on. Both sides argued over the likelihood of their success, leaving Judge Kenneth Bell to make a decision on whether the injunction should be granted.
The teams brought forward internal documents from NASCAR pondering how to avoid a rift similar to golf’s PGA Tour-Liv Golf split and whether it should just own the teams. They also showcased texts from the NASCAR board noting a potential draft charter agreement
with a “zero wins” NASCAR President Steve O’Donnell saying the interpretation would be “fuck the teams” if it went forward - implying that it needed more work.
NASCAR claimed that draft wasn’t presented to teams before noting that they got a 62 percent financial increase with the charter deal. The sanctioning body argued that it shouldn’t have to do business with 23XI as a private business and noted a text from team
co-owner Michael Jordan calling teams that didn’t join them “pussies” that will “regret supporting us,” along with a message from Denny Hamlin claiming his “despise of the France family runs deep.”
Bell urged both sides to settle before next week, when he’ll make a ruling. The teams need to have proven irreparable harm without chartered status and a likelihood for success in the case to be granted the injunction.
On that note, Bell didn’t offer much support in either direction. He noted that NASCAR could just increase the number of charters instead of issuing one of the teams’ for a sale, which also left him to ponder whether an injunction is necessary, given that the
teams could theoretically be issued another charter after a successful suit. NASCAR claimed that it would reimburse teams if any of the charters acquired from Stewart-Haas Racing after 2024 were sold.
The lawsuit remains slated for December. Bell proclaimed that the case will go to trial without a settlement, saying it won’t be decided at the summary judgement phase due to “clear disputes of fact.” He also chastised both sides for the amount of sealed information
and said the trial will be open, meaning anything presented will be public.
Bell told both sides not to be confident they’ll win at trial and admitted that “NASCAR is going to look very different” if the teams prevail.
Win or lose, Jordan seems content to see the trial through to its conclusion.
"I've been a fan of the game for a long period of time,” Jordan said in a rare statement afterward. “When we first started this whole process, I've always said that I want to fight for the betterment of the sport. Even though they (NASCAR) try to point out
that we made some money and we had a successful business, that's not the point. The point is that the sport itself needs to continually change for the fans, as well as for the teams, as well as for NASCAR, too, if they understand that.
“I feel like we made a good statement today about that, and I look forward to going down with the fire. If I have to fight this to the end for the betterment of the sport, I will.”
A quick note: I’ve summarized this as best as I can from a coffee shop in Black Mountain, N.C. But I wasn’t present in the court room and there was a lot to unpack. I’d recommend reading each of these stories from beat reporters on location to get a
better feel for everything that went down and what’s at stake moving forward:
Number of the Day: 2.6
Keep an eye on qualifying this Saturday at Darlington Raceway. Since the arrival of the Next Gen car, five of the track’s seven races have been won from fourth or better, with those winners having an average starting position of 2.6.
That said, the Southern 500 can still be won from deep in the field. Both of the two outliers to this trend came in the historic late summer showcase, when it was won from 15th (Erik Jones) and 18th (Kyle Larson) in 2022 and 2023.
