Spire Motorsports co-owner Jeff Dickerson sounds off on JGR case in new filing (NASCAR Cup)
Gibbs hired the investigator to keep tabs on Gabehart amid an ugly split between the team and former crew chief last winter. The investigator photographed Gabehart having lunch with Dickerson at a restaurant in Mooresville, N.C., in early December. It later filed suit against Gabehart and Spire for what it said was a “brazen scheme to steal JGR’s most sensitive information and use it for the benefit of a direct competitor in NASCAR.”
In Wednesday’s filing, Dickerson noted a longstanding friendship with Gabehart and called out JGR in a fiery statement likely meant to sway public opinion.
“I was surprised and, quite frankly, disturbed to learn that a competitor in our industry had hired someone to follow its former employee around,” Dickerson said. “I cannot stress this enough: It is extraordinary for an organization in our business to hire a private investigator to follow around any employee, let alone a former employee. In my 25 years of experience in this industry, I have never once heard of a team doing so.
Dickerson noted that no one at JGR alerted Spire to a non-compete despite the company being aware that Spire was recruiting Gabehart in December. He also claimed that frustrations between Gabehart and No. 54 team of Ty Gibbs - which Gabehart was helping in the latter half of the year - were obvious to outsiders.
Perhaps the most intriguing part of Wednesday’s statement was less fiery and more relevant to the moves themselves. Dickerson said JGR had failed to honor a trade deal, which saw Spire car chief Robert Smith leave for JGR in April 2025 despite having a contract with a noncompete. Dickerson alleged that Spire was granted the right to sign “a high-profile competition employee” from JGR without risk of a noncompete or to be paid $100,000 as an alternative.
The Spire leader initially said that led to fruitless conversations with Gabehart about who to hire. But over time, Gabehart’s increasing frustrations with JGR shifted Spire’s focus to him.
In the midst of this process, JGR alleges that Gabehart copied its trade secrets and proprietary data to take to Spire, where he was formally hired as a chief motorsports officer on Feb. 16, 2026. The company is suing for more than $8 million in damages and requesting Gabehart to be put on an 18-month gardening leave, where he’d be unable to work for another team.
Gabehart is already working for Spire, but with a caveat. A temporary restraining order granted by Judge Susan C. Rodriguez forbids him for doing anything that overlaps with his previous duties at JGR.
Dickerson didn’t shy away from his thoughts on the case in his statement.
“This lawsuit is an effort to stifle Spire as it attempts to build a team that, one day, could rack up the number of wins that JGR touts,” he said. “Rather than allowing that competition to play out on the track, and rather than considering what brought JGR here in the first place, JGR has chosen to attack, disparage, and demean Spire.
“JGR’s loss of talent and potential loss of sponsorships is an internal problem, not a Spire problem. That is a difficult proposition for JGR to accept.”
And on the subject of the data itself, Dickerson noted Spire’s current partnership with Hendrick Motorsports, arguably the top team of NASCAR’s modern era.
“To be clear, Spire never asked for, did not want or need, and does not want or need any information from Mr. Gabehart that was the property of JGR,” he said. “Spire has its own technical alliance with Hendrick Motorsports, who holds the Cup Series record for wins at 320 and 15 championships, and otherwise has no need for JGR’s information.
“Spire also works with General Motors for data purposes. Spire also has its own drivers, its own equipment, its own crews, its own engineers, its own crew chiefs, its own vehicle and engine manufacturers, its own sponsors, its own funding sources, and its own strategy.”

Alex Bowman out again for Las Vegas with vertigo (NASCAR Cup)
Hendrick Motorsports announced Wednesday that Bowman will skip his second race of the year with the diagnosis. He previously pulled out of the preceding race at Circuit of the Americas early.
JR Motorsports driver Justin Allgaier will pull double duty to substitute for Bowman. He’s the third different driver to run as a substitute for the Arizona native, following a partial run for Myatt Snider in Texas and an appearance from Hendrick simulation driver Anthony Alfredo at Phoenix Raceway.
“Alex continues to work closely with doctors toward being medically cleared, but he’s still experiencing some lingering symptoms,” Hendrick Motorsports President and General Manager Jeff Andrews said in a team release. “He’s put a lot into the recovery process, and we will continue to support him every step of the way. Our priority remains making sure Alex is fully ready before returning to the race car.”
After initially getting his big break in place of the injured Dale Earnhardt Jr., Bowman has endured an injury-riddled run through NASCAR’s Next Gen era. He suffered a concussion in a playoff race at Texas Motor Speedway in 2022 and missed five races. The 2023 season brought a broken vertebra in a sprint car race that cost him another three weeks and led to a lengthy recovery period. Bowman completed the 2024 and 2025 seasons without issue, but is now out for another race.
If there’s a plus this weekend, it’s that he has an experienced backup driver. Allgaier is an O”Reilly Auto Parts Series champion that won at Las Vegas in that tour last year. He previously filled in for the No. 48 at Indianapolis Motor Speedway in 2020, when Jimmie Johnson was sidelined by a COVID-19 diagnosis.
Allgaier has five Cup Series starts during the Next Gen era, including back-to-back Daytona 500s for JR Motorsports. He notably finished 13th and was rising through the field in place of Kyle Larson, who was late to arrive after a rain-delayed Indianapolis 500 run, when rain halted the 2024 Coca-Cola 600.
