Human rights Report: An Open Letter to the Government of Canada

Dear supporters, 

I wanted to share the following letter with you, which I wrote on behalf of our team to the Canadian government. You may recall that the Canadian Government committed to producing an annual Human Rights Impact Report as part and parcel of the Canada-Colombia Free Trade Agreement (C-CFTA). 

The first report in May 2012 was pretty much a non-report because "sufficient trade data is not available". The second, May 2013 Report was equally disappointing: 

"Based on an examination of the actions taken under the CCOFTA, it is not possible to reach any conclusion on whether any changes in human rights in either country have occurred." 

Thanks to an Amnesty International Report I read this morning I learned that today was the very last day of a very short one-week window in which the Canadian government is/was accepting submissions of human rights violations. 

 A call for submissions by “interested parties” was quietly posted on a government webpage on March 19, 2014. The deadline given for submissions is six working days later

Time did not allow for any kind of a comprehensive report, so I wrote this letter and simply submitted the denouncement we received today from our friends and grass-roots human rights defenders, CAHUCOPANA. This denouncement is by no means the most serious. It happened on Monday, but Carlos didn't even mention it when he came over for a visit last night. He had a very similar experience in near Medellín in late February. My friend and teammate  Hannah and I leave on accompaniment with Carlos of CAHUCOPANA into the interior of North-east Antioquia tomorrow. We will travel through the very place in which this most recent human rights violation took place.

Human Rights Violations in Antioquia, Colombia

 

I am sending this at this late hour because Amnesty International alerted us that a single week-long  window of opportunity to present reports of report human rights violations in Colombia opened a week ago and closes today.
Human Rights violations are something we witness in Colombia on an almost-daily basis, as demonstrated by our web page and email list serves.

Previous Canadian Government Reports on the Human Rights Impact of the Canada-Colombia Free Trade Agreement have not been encouraging. The first basically said there wasn't enough time to compile data, and the second suggested that there was not enough evidence to demonstrate that the human rights violations occurred because of the Canada-Colombia Free Trade Agreement. The onus, apparently, is on those of us reporting human rights violations, and fortunate  enough not to miss the one week opportunity to make submissions, to demonstrate that these violations would not have occurred without the FTA. These requirements pretty much ensure that the Canadian government will never have to acknowledge the negative impact of the FTA.
From our perspective the question is not whether or not the human rights violations would have happened had the FTA not been ratified; but rather, would the FTA have happened if it were not preceded by violent, deadly and extensive violations of human rights on the part of the government itself in alliance with right-wing paramilitaries--the United self defense forces of Colombia (AUC). The vast majority of these crimes go unpunished, and human rights violations continue. There are no assurances whatsoever that these crimes will not continue indefinitely, and despite laws and rhetoric about reparation and land restitution, the evidence shows, for instance that five million victims of forced displacement are more likely to be re-victimized --killed or displaced again-- than they are to get their land back. 
There has long been, and continues to be, a great deal of civil resistance to the Canada-Colombia FTA, as well as other FTAs. Civil resistance on the part of labour unions, indigenous, Afro-Colombian, campesino farmers, and traditional artisanal miners. It is precisely these groups who are the primary victims of human rights violations because they resist handing their local resources and access to their local markets over to foreign corporations. It seems that constant human rights violations against these groups have successfully debilitated them to the point were foreign investors feel that they will no longer be able defend their land, market and resources. With an FTA firmly in place corporations are assured that successive Colombian governments, under the obligations of the agreement and International Trade Tribunals, will use their security forces to protect, not the victims of on-going human rights violations, but the corporate investors (including the Canadian Mining and Petroleum Industries).

While much of the rhetoric of the Colombian government, and many of its laws, seem to favour victims, the reality on the ground is completely different. The fact that most past violations remain in impunity does nothing to deter future ones. The Law of Victims, and Law of Tierras proposes reparation and land restitution, but virtually none of it has yet taken place, and those brave enough to apply for it are receiving new threats. While the new  Unidad Nacional de Proteccion (replacing the corrupt and now defunct Administrative Department of Security--DAS)  issues bulletproof vests, armed bodyguards and armoured vehicles to community leaders and human rights defenders, they do virtually nothing to promote restitution and justice for victims, nor is it respected and acknowledged by other state security forces. The attached PDF file about a human rights violation experienced by Carlos Morales, director of our Colombian partner organization CAHUCOPANA, while being harassed in an irregular police checkpoint, is emblematic:

We sincerely hope that the May 2014 report will be more comprehensive than previous reports, and that issues like impunity and lack of guarantees of non-repetition are addressed. Also that the next report will not be satisfied with Colombian legislation and programs purporting to protect victims with assurances that these laws are being enforced and these programs implemented in a timely manner. Victims iof human rights abuses won't be adequately protected unless they are assured  that both past and future crimes won't go unpunished.

CORPORACIÓN ACCIÓN HUMANITARIA POR LA CONVIVENCIA Y LA PAZ DEL NORDESTE ANTIOQUEÑO
NIT: 900054785-1

Policía Nacional desconoce esquema de seguridad de la Unidad Nacional de protección y arremete contra dirigente de Cahucopana
La Corporación Acción Humanitaria por la Convivencia y la Paz del Nordeste Antioqueño CAHUCOPANA denuncia a la opinión pública nacional e internacional, instituciones, organismos gubernamentales y no gubernamentales, la violación de los Derechos Humanos del líder campesino CARLOS MORALES MAYORGA y su esquema de seguridad, a partir de los atropellos a los cuales fue sometido por parte de miembros de la fuerza pública en el municipio de Yondó, departamento de Antioquia, el día 24 de marzo de 2014, aproximadamente a las 4: 00 pm.

ANTECEDENTES
1. El día 20 de febrero a las 9:00 pm, en la vía que de la ciudad de Medellín conduce al Municipio de Remedios (Antioquia), a la altura del Municipio de Copacabana, Autopista Norte, fue retenido por agentes de la Policía Nacional el dirigente campesino CARLOS ARTURO MORALES MAYORGA quien se movilizaba acompañando por el esquema de seguridad asignado por la Unidad Nacional de Protección. El escolta señor JUAN GUILLERMO ROJO, e igualmente lo acompañaba el señor MELKIN CASTRILLON, líder de la Asociación Campesina del Valle del río cimitarra ACVC. Todos se identificaron como es debido con sus respectivos documentos de identidad, ante la solicitud hecha por los agentes de policía y pese a esta identificación fueron trasladados por los agentes a la estación de policía de Copacabana, departamento de Antioquia, donde fueron recibidos y atendidos por el teniente ALEXANDER SAAD HERRERA, a quien también se le identificaron este al darse cuenta de quienes eran, alzó la voz y comenzó a tratarlos mal, pues palabras más, palabras menos, les dijo “esos hijueputas se creen intocables”

HECHOS El día lunes 24 de marzo de 2014, en el Municipio de Yondó – Antioquia siendo las 4:00 p.m, en un puesto de control instalado por la Policía Nacional, el agente de policía, patrullero GIOVANNI AMAYA CRUZ, solicito los documentos de los escoltas asignados por la Unidad Nacional de Protección, esquema de seguridad que le fue entregado a CARLOS MORALES, en calidad de coordinador y representante legal de CAHUCOPANA. Los escoltas accedieron a la entrega de los documentos y se identificaron como escoltas de la Unidad Nacional de Protección, a lo cual el señor AMAYA CRUZ manifestó desconocer este programa del Gobierno Nacional, varias cosas para señalar y denunciar en este procedimiento: 1. El patrullero, AMAYA CRUZ, en forma grosera, altanera y prepotente, se dirigió a los escoltas y al compañero CARLOS MORALES, aduciendo desconocer el programa de Unidad Nacional de Protección. 2. Ubican un puesto de control en una vía transitada sin las respectivas señales de tránsito y de Policía. Es grave e inadmisible que en una zona de orden público y de alta presencia de grupos armados ilegales, se instalen puestos de control por parte de la policía sin las respectivas señales que identifiquen el mismo. 3. El patrullero se refirió a los escoltas y a Carlos Morales, como personas “antipolicías”, según él por no prestar colaboración, cuando desde el inicio del procedimiento los escoltas y el líder, se identificaron plenamente, con sus documentos de identidad y los respectivos carnets que los acreditan como pertenecientes a la Unidad de nacional de Protección.

CAHUCOPANA denuncia estos hechos como casos sistemáticos con los cuales se busca impedir que las comunidades y en este caso los líderes campesinos cumplan con sus labores de defensa, denuncia y visibilización de lo que sucede en los territorios.
De la misma manera nos preocupa que siendo La Unidad Nacional de Protección un organismo de seguridad del Orden Nacional adscrita al Ministerio del Interior, encargada de articular, coordinar y ejecutar medidas de protección y apoyo a la prevención, promoción de los derechos a la vida, a la integridad, a la libertad y seguridad de personas o colectivos, los miembros de la fuerza pública desconozcan dicho organismo y omitan las recomendaciones para el trato que se le deben dar a las personas que cuentan con el esquema de seguridad. Mientras tanto con el argumento de desconocer el programa, se seguirá atropellando en forma abierta y flagrante a las personas defensoras de derechos humanos y a quienes han sido asignadas como escoltas. Es necesario denunciar que con estas conductas se viola de forma flagrante los derechos fundamentales consagrados en nuestra Constitución Política, como son: el derecho a la igualdad artículo 13, derecho a la libertad de locomoción artículo 28 y derecho a la libertad de asociación artículo 38.

EXIGIMOS:
- Al Gobierno Nacional, su inmediato pronunciamiento frente a este hecho y en igual sentido la pronta respuesta por parte del comandante de la Policía del Departamento de Antioquia, por el hostigamiento del que fueron víctimas el señor CARLOS MORALES y su esquema de seguridad.
- Al Ministro de Defensa: Que se pronuncie frente a este hecho en el que resulto víctima un líder campesino quien en forma constitucional y legal desarrolla su trabajo en una parte del territorio nacional.

- A la Procuraduría General de la Nación: Que mediante sus delegados en el Departamento de Antioquia, preste especial atención y haga el respectivo seguimiento a la denuncia disciplinaria que se formulará en contra del patrullero GIOVANNI AMAYA CRUZ.

SOLICITAMOS:
- A la Unidad Nacional de Protección: Que eleve queja formal a la Policía del Departamento de Antioquia, por el comportamiento desplegado por el patrullero GIOVANNI AMAYA CRUZ en hechos ocurridos el día 24 de marzo de 2014 a las 4:00 p.m. y ampliamente narrados. Así como instruir a la fuerza pública en el trato que se les deben dar a las personas a las cuales se les ha asignado el esquema de seguridad.
- A la Defensoría del Pueblo: Que hagan el respectivo seguimiento del proceso penal y disciplinario que se instauró en contra del patrullero GIOVANNI AMAYA CRUZ.
- A las organizaciones Defensoras de Derechos Humanos: Que se haga una réplica de esta denuncia, a todas las organizaciones defensoras de derechos, pues esta situación de hostigamiento y persecución se repetirá, pero en la medida que mantengamos sistematizada la información y una verdadera red de apoyo evitaremos que los mismos se repitan.
